The ow was threatening to file because H wouldn't giver her More.He was already paying her 3 times the amount he needed to .Anyway, a woman called yesterday from the Child Support Bureau ,at our business, asking for H .I didn't get the message.Do you think it means that ow has filed and they are calling for his appointment? I thought that papers were suppose to be sent first. Why else would someone from there call.I pray that she has gone!

I don't know where you're from, but around here the Child Support Bureau doesn't get involved until paternity has been proven (if the father will not submit to a paternity test then the mother must get a court order). Then you must go to court for a child support hearing where support is figured using a standard worksheet taking into account the fathers income and the mothers income. The court decides how much is paid. Once the court order is in effect then the CSB is there to make sure the order is enforced. Hope this helped.

Afterthought. I'm not sure of your story but it sounds as if you and your H are paying this woman support payments without having been ordered to do so in the hopes that she won't file. If that is the case, I hope that you are keeping some kind of proof of these payments(cancelled checks) because if your H is ordered to pay someday he will be responsible for back payments. Meaning he will owe from the time the baby was born up to the time he was ordered to pay. My daughters' father(even though he knew he was the father and volunteered for a paternity test and fully expected to pay support)did not make payments until the court order went into effect when my daughter was 6 mo old. He had to pay me 6 months of back payments in the amount of $2500. Now maybe he wasn't worried about it because he has that kind of money but most people don't. Please keep records!!

I agree with Want it back in keeping a paper trail, but in our state,(Louisiana) we are required to pay only from the date filed onwards...not retroactive to the birth. It is best to find out what the laws are in your state and go from there, but a paper trail and proof is a given.
Hope you find the answers you need...
Praying and hugs,

My h signed the birth certificate. Paternity has never been proven. He has kept all cancelled checks.

blue00,
Has your H sued for paternity? Does he know it is 100% his? I would sue for paternity. How old is OC? There is a status of limitation. I would definetly contact a lawyer and find out on what to do next.
Dawn
