On my divorce application there was a discrepancy regarding my STBXWW’s name between the application and the marriage certificate. They need to be consistent so they know they’re divorcing the right people. It has delayed the proceeding somewhat, but that’s about it. She was supposed to go into her lawyer’s office to swear an affidavit to the amendment, but has used that as a bargaining tool to change the parenting arrangement. Her lawyer has said to mine that they will complete the process as soon as I agree to change the parenting regime. I refused, they backed off.

Now I have to get a “chambers order” from a judge to force them to comply which I’ve instructed my lawyer to pursue. They cannot hold the process up forever. I’m sure the protocol is the same or similar in your province. As soon as they know the chambers order is imminent, they will sign. It’s a lawyer game….played the same way everywhere.
