xH has four kids by his first marriage. The divorce was five years ago. He left to be with OW and married her. They had a baby together this year. He's been back to court every year to get his child support reduced and almost always wins. Magistrate said first babies are more expensive to raise than existing children. Therefore, $450 of his child support is to be used in his marriage with OW to support their baby. The remaining $800 goes to the four children from his previous marriage. How is it possible (Pennsylvania) that one child should get $450 and four kids only get $800? Is there an age where his OC is considered the same expense as the other children he has fathered?

Egads! I don't know anything about child support in Pennsylvania, but I know I'm slated to get $1200 for the two of my kids who are under 18. Wish I could help...maybe search the internet for "divorce Pennsylvania". That's how I double check a lot of information about the process where I am.

In Wisconsin they have a whole statute (sp?) about how the children from the first relationship get first dibs on the parents income and the children from subsequent relationships get a percentage of the remaining instead of a percentage of the whole. I'd check into that one carefully. There could be another reason it was done this way though, employment of the mother or of the children of working age perhaps? Shot in the dark. Elizabeth
