In a ruling sure to make philandering spouses squirm, Michigan's second-highest court says that anyone involved in an extramarital fling can be prosecuted for first-degree criminal sexual conduct, a felony punishable by up to life in prison.

Adultery is a felony in your state ... you were just acting to stop a felony in progress! The court would have to go easy on someone who was trying to prevent a respected OFFICER OF THE LAW from committing a FELONY!

Lil Sis,

Had a few minutes to think this over after I went to the read the actual court of appeals decision.

I was going to suggest going to the prosecutors office, bringing the copy of the case and article with you and sitting down with them and inquiring about pressing charges. I KNOW the Prosecutors Office in your county WILL NOT go after your husband. He's a cop. Unless they HATE the sherrif's Office in your city...they are all part of the buddy system. If and when a test case EVER appears on this issue it will be some repeat offender they desparately want to keep off the streets. Someone completely unsympathetic to the general public (not just us). Also, they KNOW you won't follow through prosecuting your own husband. They will want a vindictive as heck ex-wife. (that is, unless they are prosecuting the OW, lol).

The Court of Appeals, by footnote...merely indicated that they would feel obligated to allow prosecution of an adulterer under the current Crim Sex Conduct Law. It was a tongue in cheek slap at the legislature and the Supreme Court. It does not mean the Attorney General or County Prosecutors are actually going to get in the business of prosecuting adulterers. They want nothing to do with domestic disputes.

Look at it this way...according to the Corut, Adultery has long remained a felony in Michigan but nobody has been prosecuted for it since 1971.


ALL THAT BEING SAID - BECAUSE the prosecutors office and cops work together in the buddy system what a GREAT place for you to expose by going there and requesting a meeting with a prosecutor to discuss the potential of such matter. You could insist on pressing charges versus OW, not your husband. Her stbxh is a lawyer...they may like him and want to help him or they may dislike him and want to go after his family. OR, some of WH's brothers and sisters in uniform may see you at court and the exposure will go even further.

So, do I email the article from the Detroit Free Press to WH, with the message, "Well, well, well....." He reads the Free Press online everyday; hopefully he already saw it and freaked.

I do have a friend that is a prosecutor in Michigan.

I emailed him the article and full case.

I told him he has the opportunity to really make a name for himself IF he were to go after some adulterer in his county. Prosecutors ARE elected officials...which is one way to persuade them to consider it.

I'll see what his response to it is.

p.s.- Don't know what the statute of limitations is on CSC...but; like I said, Adultery itself was always a felony and NOBODY got prosecuted for it since 1971. I wouldn't get excited about this footnote in a Court of Appeals decision as an indication they are now going to go after adulterers in Michigan. Only get excited if and when it ever actually happens to some deserving man/woman. Until then, it's a pipe dream.

Absolutely, but if it makes my WH (as a cop) and skanky HO RT sweat for just a teeny tiny minute, I'm satisfied. Unfortunately, they'll probably just laugh: "Oh, how silly! Why don't they spend their time looking at REAL criminals, like LilSis?"

Just a little bitter, and even the slightest whiff of justice is somehow...energizing. Can ya tell?

The reward may just be in pursuing it

AND

You never know...

You may just walk in on the most opportunistic prosecutor in the office that wants to make a name for him or herself by pursuing such claim. Maybe even a FBS with religious or other strong convictions about adultery. You are in Dutch Reform/Calvanist country over there.

They may not completely follow through. But, how shocking would it be if they even investigated the claim and drug in OW for questioning.

What someone should do is take the proof to a Prosecuter and ask for the WS and OP to be prosecuted.

Even if it is an antiquated law if it is on the books still it is illegal.

I think the main issue is making sure the information you hand over has been legally obtained.

Many things that are recommended here are not legal.

So I guess hiring a PI would be the best idea.

I can't wait to see someone arrested for this and then prosecuted.

I hope someone in the DA's office does want to make a name for themselves.

Hey, Mr. W ... Do you think it would make a difference for Sis to just mention it to the prosecutor in HER case? Something along the lines of prosecuting ALL of the felons in this case ....? My guess is that WH and OW both already admitted their relationship when the first incident happened.

Would it have any effect on her sentencing?

Doubt it. It's irrelevant....just like the "everybody else is doing it defense" HOWEVER I'm not a criminal lawyer so who knows. It's not like she's up against time in jail...it's merely a slap on the wrist and she's already plead guilty. The case is OVER.

BTW, I got an email from good ole Jimm5... that indicated the Statute of Limitations appears to be 6 years in Michigan....meaning they could go back and prosecute old adulterers if they were so inclined. But trust me...that AIN'T gonna happen anytime soon. They would need at least ONE solid unsympathetic test case with rock solid proof first before any Prosecutor in Michigan is going after random waywards.

The way this all actually could likely end up being tested is when someone gets actually charged with Sexual Criminal Conduct (caught doing something in semi-public with their mistess) and they try to weasel out of it saying it was consentual and being carried out in private. The crafty Prosecutor MAY then just end up saying "so what" ... it's adultery, which is a felony and we can prosecute you for CSC 1 anyway". Then the case makes it's way up the Appeals ladder and hopefully sticks (which I doubt).

Perhaps we should consider just instituting sharia law so that we can stone adulterers to death if they are married and punish sex out of wedlock with 100 lashes.

An adulterer can walk away with half your assets plus spousal support and custody of your kids after giving you an STD.

Sounds like a GREAT place for secular law to intervene.

Penalizing adultery has nothing to do with religion at all. Sure I would probably garner support for it from the religious community, but adultery in today's society is tantamount to Russian Roulette, and in a society where there is no penalty for adultery (as in our civilized western societies) adultery is glamorized and practically revered in media, certainly granted social acceptance. That needs to stop in a big way.

Like you, I have a strong opinion also. Stoning may be extreme for Westerners so how about Penitentiary instead.

The woman who ran over her adulterous husband is serving jailtime, I should have been her lawyer: Betrayed Spouse PTSD is a fact just waiting to be proven in a court of law, adultery is a lethal form of the most insidious domestic abuse. I can't wait to get my law degree! You'll know my true identity when I do. I'll be on a crusade for justice.

10S: If I weren't such a chicken, I probably would have been a good test case for you. I'm SURE I would have met the DSM criteria for PTSD. But baring my soul on this forum is public enough...there's no way I would have gone to trial and subject myself to public scrutiny in my own community. I've been humiliated enough.

That said...I wish you luck! Go out there and kick some wayward a$$.
