LWIT,
I truly feel your pain right now. I don't know about you but I am going to an attorney tomorrow.

I am sorry for all your pain FIM and Texas. I think going to an attorney is a good idea to protect yourlselves BUT please remember the universal truth of affairs. THEY ALAWAYS DIE !!!!!!!!!! If you want your marriages bad enough, there will ALWAYS come a time when you will get the chance to "win back" the love and committment of your WS. Knowledgeable posters such as Believer, Melody Lane, etc.. are very wise people and instructed very well in Marriage building principles and can help you stave off divorce while your WS affair runs "it course". Read the Harley books, the affairs will eventually die. It is just up to you if you want to or are able to "stick" around untill they do. <small>[ November 11, 2004, 10:56 PM: Message edited by: lemonman ]</small>

Sorry to hear both of your's pain. It's really tough when you give and give and then they just stab you in the back like this.
My thoughts are with both of you this evening. Stay strong as you can given the cirumstances.

My WW was in an emotional affair. They had kissed and slept in the same bed together but no sex, until NOW! I am sure that last night and tonight they are having sex!
I decided when I let her go yesterday that if she was with OM then I was done. She looked me in the eyes and told me three times that she was not going to with OM! Lying Beeeyatch!!!!

My WW has a terrible spending habit. She has dug us into $30K cc debt. How do I go about freezing the accounts so she can't bury us deeper?

Hi, MIF. Call the credit card company immediately and tell them to cancel the credit cards that list you as the primary card holder. ANd ask for ones just in your name - no secondary card(s). I think you can also just cancel hers and leave yours active. However you cannot do that if she took the card out in her name. THEN, you will need to go a lawyer and draw up papers stating that from this day on you will be only responsible for debts incurred in your own name.
I am in Canada so that notice of non-responsibility had to be in the newspaper for 3 days. Don't know about in the US but I believe it is the same. YOU CAN DO IT NOW! They are open 24X7 <small>[ November 11, 2004, 11:58 PM: Message edited by: fightingalone-again ]</small>

What happens if I am not on the account?
I know I will be responsible for half the debt, but what about if she keeps racking it up?

First thing tomorrow, call a lawyer and ask about the non responsibility bit. You might be responsible for half up to the date that you get the notice done.
Forgot to say that this will notice will cover ANY debt that she incurs form this day forward. Even if you stay married unless you rescind it, you will not be responsible for her debt such as buying a car, mortgage, lease, etc. Good thing to have when one spouse spends way too much. <small>[ November 12, 2004, 12:08 AM: Message edited by: fightingalone-again ]</small>

Separation agreement. Once signed by both parties, all debt that is accumulated after that date is the sole responsibility of each person in the marriage.

Hi TTSI, Yes, but that will take time and if he decides to stay married or cannot get the separation agreement signed right away or she stalls until she maxes out everything he could be in even deeper debt. You do not need a separation agreement to go forward with the notice of non-responsibility. AND you don't need her signature.

Hi there FAA, I don't know if we have those in the U.S. or not. I may be wrong, and if I am, I am definitely P.O.ed at my lawyer for not talking to me about it after talking with him about protecting myself and my rights. <img border="0" title="" alt="[Smile]" src="images/icons/smile.gif" />

Check this link out. It also says that IF the debt does not benefit you in any way, such as clothes for her, you are NOT resposnsible If the credit card is only in her name. http://cobrands.public.findlaw.com/newcontent/flaw/chp4_a.html

<img border="0" alt="[Teary]" title="" src="graemlins/teary.gif" /> Yup, same boat as me, I think. Sick isn't it? I always thought that it should be forever. TTSi, I am pretty sure that there is something similar. Here is a link that I found with a basic form letter and it is American. http://www.formsguru.com/forms/legal-forms/notterde.htmlLooks like it also depends where you live in the US. Here is a Minnesota link. http://www.wilder.org/goodage/Legal/law1101.html
