Ladysheep, not yet. I just talked to the IRS yesterday. I wasn't sure until yesterday that I could "refile". And of course, I want to ask WH if he is sure that the troll is what he wants before I file the taxes. But I am having a very bad day today and decided it would not be prudent for me to talk to him today.

I understand Jean. WH is gonna freak. I hope he saved all his info for refiling if he needs to. My BIL is a CPA who usually does WH's business taxes. He ran the numbers for me and it will cost WH a little more if I file MFS. His cost is not my primary concern, me not being liable for his self employment tax is my main concern. This doesn't make sense that BIL would say that because you cannot file MFS, as Pepsi said, so I don't understand how he figured anything. It might be wise for you to hire someone to do your taxes. Only because you have 3 years of taxes to file, and some problems with the last filing of no signature. Get some good advice Jean. You want to be sure you are filing the safe and right way. Lady

BIL did not say that couldn't file MFS, just that it would cost us both a little more. BIL does not want to be involved in this, he is WH best friend since they were 12yo. But since he has handled our taxes for years, I asked him to print me off the stuff I needed as it was all in his computer still.
I know WH will freak, and I am just not up for that today.

BIL did not say that couldn't file MFS I'm sorry Jean, I was thinking you were filing single. DUH....MFS (Married filing seperate). I knew I should have got away from this thread 4 posts ago. But I do wish you the best in filing, and revealing the new to WH. It's good BIL has the info for previous 2 years, that will help.

Thanks Lady, I really appreciate that you check in on my situation. I do wish things were going differently, but it will all turn out like it is supposed to.

But considering that we have been running two years late on filing, I might not have to talk to WH about it for quite awhile.
And that goes into the whole pros and cons list of marriage to my H (wayward or otherwise). I can be single and owe $100 bucks or so in taxes, or I can be married and owe , oh, $14,000-$16,000 (and that doesn't include the 2005!)

Jean,
You probably should have someone prepare your taxes for you and not H&R Block! It will cost you more money but go to a CPA or attorney.
There are many programs where you can get free advice from CPA's and in some cases the IRS will assist you in preparing your taxes. If you KOW you owe taxes and do not pay and specially DO NOT FILE you'e subjecting yourself to unnecessary interest and penalties. I implore you to take care of YOUR taxes and not worry about WH's. If you decide to refile under different circumstances like married, jointly, you can get refund for up to 3 years!
Although I am a CPA I am NOT a tax professional. Taxes are LAW, not theory. Unfortunately your situation is NOT isolated and happens more and more every day.
