Regarding the kids?
Let the Dom parent claim the kids. The Dom Parent may ELECT, via form 8332 to Grant the Exemption to the Non-Dom parent.
Then, no CS, no Exemption.
Then, File on Jan 15, Electronically, Every year.
The IRS sticks with who files first. And rejects the second to file.
Everything else is a P!ssing match and the IRS doesn't want to be involved.
So, FILE FIRST! Nothing, I repeat, nothing wins better than that.

Would I not get a comtempt of court filed against me? This is going to be in our paperwork...standard stuff...
Louisiana says that if he pays over a certain percentage in CS, then he gets to claim them unless he's not current on CS...

I would also recommend that it is taken directly from his paycheck. The CS that is.

Because, in my experience, if someone wants to follow the divorce decree, then there isn't a problem. But when one of them decides not to follow the agreement, the one who is following it, has to file the contempt of court charge.
I agree, and will continue to agree, that the IRS should not profit from your marital problems.
But, in Divorce situations, money can override everything.
File First, File Correctly, and don't worry about it.

oKay, LG, I understand that he would have to file the comtempt of court against me...
I have no problem doing it...this year I filed Jan. 29th...and only b/c I had to wait on POWS's stuff...
I'm just concerned that POWS ACTUALLy follows it and getting in trouble...I guess the worst that would happen is I have to pay him back the money...which I "probably" will not have when asked about it...
It's so confusing...I need to find a estimator tax forma nd play with it to see for myself...I'm a visual learner...I have to see the numbers...
MOF, I need to figure out what I need to claim on my W-2 form...I think I'm claiming 2 right now...

WEll, POWS TMed me a minute ago about CS check...I'll be getting it in the morning...
He was nice, said please and asked that I let him know that I got it...I was nice and said thank you, I would...
Then, he said K, good nite!
I suggested that we meet at the bank, but I was open to suggestions, he said since I pass the house every day that he could leave it in the mailbox...
I said that was cool...to be on the safe side I'll pass there on the way to the sitters and make sure that he's not there, then pick it up on the way to work...
Can you tell I still don't trust him? LMAO
I was a bit surprised at how pleasant his TMs were...oh, well...what doesn't kill us only makes us stronger!!

No, sweetie...still waiting...only thing different, i got CS this morning and I found out when I called in my car payment that he's a 30 days past due on the truck...
I just told the lady, I'm sorry I understand that this is affecting my credit score but I can not pay his truck...
I have takin care of him long enough and this is just something that I'm going to have to deal with...all of my bills are current, perhaps that will off set his damage...
I'll deal with it, POWS wouldn't have the credit score that he does if it wasn't for me...I'll survive that too!
In the meantime, I've been looking at houses in the area to know what options are available to me...called a mortgage company and asked some questions about purchasing a house of my own at this stage of the game...
It's possible, so I'm in the position of having more than one option with the whole house thing...should this become a big problem with him, I'll just tell my Attorn. to get POWS to give me 10K, he can borrow against his 401...use that as a deposit on my own house...
Then, maybe at the same time we can do the refin. on the house...probably cashing out my equity and using that to furnise the house with ALL NEW STUFF... <img src="/ubbt/images/graemlins/smile.gif" alt="" />
Plenty of options...I'm just sticking to my guns right now...I feel like that's what I need to do...gut thing...but still weighting the options...

Thanks BUgs, the boys, Spon, and I are baking some cookies for POWS tonight...L wanted to make something for his dad!
I have plans to bring them to the movies, maybe tomorrow, and I'll probably find something else fun to do with them...
just keep busy...still hoping to hear something today on whether POWS is going to push the issue or not about going to court...Then I would really have a reason to celebrate and have fun with the boys...
I was thinking about bring them to "Jumping Kids", it has bounce houses and stuff in them...they have been wanting to go...
I don't know... easy does it this weekend...especially with the lack of sleep I've been getting...LMAO

hi, all...I'm still waiting on an answer...I had a wonderful weekend with the boys and family...
Today, I am getting frustrated waiting...nothing from POWS' attorney...limbo still...I'm ready to move forward...being impatient is what I'm being...
Just a rough day I guess...I woke up late again...8am, should have been at work...really busy this morning at work, the morning fell by...checked on a house at lunch...did some research on the values in the area...right next door to school...F could walk...better school district for both...
well, just a little update...not as excited as I was yesterday...I was bouncing all over the place yesterday...planned a b-day party for the boys...renting a bounce house for them on the 30th, cake and hotdogs at my uncle's house...
