Just got off the phone with nice lawyer man.
OW was trying to have cs increased. He informed cs agency he was going to require her to turn over checkbook and tax records proving that she has been paying daycare. ( H pays an EXTRA $75.00 per week for daycare )
Guess what???!!! Grandma has been keeping oc all this time, ow hasn't paid one red cent for childcare !! And the best part is, OW HAS TO PAY US THAT MONEY BACK !!
Like my grandmother use to say : The sun don't shine up the same dogs butt all the time .

WOOHOO!!!!!!!!!!!!!

I am so glad for you that she didn't get away with this. It is amazing the lies that follow after the deception that has already been uncovered. I here more and more of what people try to get away with...and it really breaks my heart.

I love stories like this. My brother almost got screwed over with medical bills for his child. He has to pay for 100% of unreinbursed medical and his ex took their child to a doctor that was not covered on the insurance plan. She did it to cost him lots of money. Well he had the last laugh. He only had to pay 10% of it and she had to pay the other 90%, but not before he had to shell out money to a lawyer.

Sorry for all the questions but does she have the money to pay that back? Will it be taken out of the CS? Does she know yet she has to pay all that money back?

Tiffany, that's a great story. I wish it always worked like that.

I have a friend whose H's X-W purposely got $10,000 worth of dental work done on their child during the ONE brief time he didn't have dental insurance, just to rake him over the coals, and YES, the court said the father had to pay it in full, the same time they raised his ch-support payments! <img border="0" title="" alt="[Mad]" src="images/icons/mad.gif" />

It's nice to see justice at least Occassionally!

OUCH!!! 10k is a lot of $$$$. His ex ran up a $3,000 bill. Ever since she got stuck paying 90% of that bill she has behaved herself. She has caused other problems in the past like denying his visitation. The only thing the courts did to her was warn her twice and he got to make up the visitation time. She denied him X-mas one year. Well the next year he got the full two weeks and she got her only 2 hours on X-mas Day. I hate that woman with a passion. What kind of person denies X-mas visitation. She has put him through so much hell. Don't even get me started on child support. She tries to take him for an increase every year even though our state only allows it every 3 years. She will file anyway. Done with my rant. <img border="0" title="" alt="[Big Grin]" src="images/icons/grin.gif" />

Yes, she has to pay it all back. She obtained money under fraudulent(sp ?) terms.
I don't know if she has the money to pay it back and don't give a darn. She better get it from somewhere.
No, it will not come out of cs. Remember, that is for the child <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" />
Yes, she knows she has to pay it back. We have 60 days to decide if we want it in one lump sum or will accept payments. I want her to sweat big time. We told our lawyer to wait until day #59 and then let her know we want one lump sum.

Just a footnote.
Even though the payback will not come out of cs our cs has gone down $175.00 per month even after her %15 increase because of no day care expense.

Now, a judgment is one thing, getting paid is another. I pray that you get PAID in Jesus' Name! If not, maybe you could have the payments cut off until the rightful adjustments are made... You have a terrific lawyer!!!! Way to GO!

What a great day in the annals of the Pregnancy/Child board. Horray for the JTiggers. I really don't mind our amount of child support but I love to hear it when someone who was just out for the money (and was cheating and lying to get extra) gets her own. Bet she's having trouble sleeping. I know I would not be sleeping too well and would be throwing up every hour from all the anxiety if I were in her situation.

Gee, you mean I may have to have her served with papers while she is at work so she will die of embarrassment, or take her to court every month or better yet have her wages garnished.
It will never happen, life just can't be THAT good.
