Sounds like a dumb question, I know.
When I talked to a mortgage lender, they told me I need to get the divorce first in order to put the new house in my name only and have STBXH out of the picture.

When I talked to the mediator for the divorce, she told me that I need to sell my current house before I get the divorce so we know how the assets will be divided in the dissolution of the marriage.


So, that means the kids and I would have to find a temporary place to live between selling the old house and buying the new one.
I will barely qualify for a new house (townhouse is what I want)on my own, so I have no choice but to sell the old house - can't have two mortgages at once.

Anybody know how I should do this? I am not at all knowledgeable on this this type of subject.

Hi Suzy - seems to me the only recourse you have is to rent a place temporarily while all the proceedings go on.... Once the assets are divided, you can then buy the new place in your name - you definitely don't want his name on the new place!

I'm SO SORRY this is happening to you! I'm in the middle of the whole nasty mess right now and I just wish things would go away. I hate the whole mess - this has not been one of my better years.

Been AWOL for a few days, but I agree with Tan,

You need to sell the house and get D first. Divide the assets, use whatever money you get from the sale of the house to buy a new one. You may need your H's income now to get a loan, but you'll have child support and so forth after the D that you can show as income. You'll have to rent something temporary until then though.

Don't forget to shop around for lenders too. They are falling over each other to loan money because competition is fierce. If your income alone isn't enough, you could try something different like a lease option. Don't buy a new house while you're still married though.
