hi. I understand that if the check is also in your name, you definetely can deposit it in your bank account. I don't see why it will be a problem. Can you check with another bank and open another account if necessary?

Does the check say "you AND husband" or "you OR husband"?

i don't have the check yet

the truck title is still in both of our names so i'm assuming the insc co has to issue the check in both our names

i could ask them to issue it only in my name but i doubt they will....if you could explain the importance of the AND/OR it would be great! the bank also asked this question but i didn't understand why

i could ask the insurance co to make it a certain way (with the AND/OR whichever is best)

If you put in the back of the check "For Deposit ONLY",and your acount number and deposit it. You will have no problems with that check. YOU dont have to sign it, just put "For DEPOSIT ONLY" and your bank account number. I have done it lots of times, with checks to my husband and myself, and also checks that are made to my daughters and I deposit in my bank account.

If it says you OR your husband only one of you needs to sign the check. If it says you AND your husband then you both have to sign it.

I've done the same..as Myrta recommends..ZILLIONS of times..with H's and sons' checks..using FOR DEPOSIT ONLY...and then signing your name. Use a teller that knows you or with whom you've developed a "BANKING RELATIONSHIP".. <img src="/ubbt/images/graemlins/smile.gif" alt="" />

Over the years, I've endorsed and deposited MANY checks made out in both my H and my names. Heck! I even endorse and deposit checks made out only to my H!

The trick is to DEPOSIT the check, because that gives the bank recourse, just in case the insurance company says anything.

I recently received the escrow money from the sale of our house, and I just signed my name and deposited into my account. It said "and"--but for some reason they didn't say anything--probably because I deposited it. I then wrote WH a check for his half.
You don't know how badly I wanted to keep it all, as I was stuck with half the debt--most of which he charged in the months before leaving as he was establishing all the things he would want and "needa' as a single guy. But I didn't keep it--even though he had NO idea we even got that check.

i wonder if the insurance co would write "or" if i ask them to....then there would be no problem!

otherwise.....let me make sure that i understand....the deposits referred to in posts above refer to INDIVIDUAL accounts NOT to JOINT accounts with your H?

so i could deposit the check even with NO SIGNATURE if i write for deposit only and put my account number?or should I SIGN? I would be so happy if i could deposit the check without needing to get my H's signature at all!!

it makes sense what Lady said...that if i DEPOSIT the check the bank can have recourse

i guess i can try it and if the bank won't deposit it without my H's signature....i can deal with it then

i did call the insurance co and ask if they could issue the check just to me or write my H OR me on the check as suggested on my post about this question

they said they could NOT issue the check just to me and could write OR only if the title said OR

i'd appreciate some replies to my clarification questions above

I agree with the "For Deposit Only" approach regardless of whether you sign your name or not.

However, be sure you approach the bank teller looking like you know what you're doing -- business as usual -- nothing wrong here.

If you stop to ask the teller, "Is it OK if I do this?", he/she may take the "official" approach which may not work to your advantage.

Walk up to the counter, give him/her the check, deposit slip and ID and stand there as if you aren't worried if it will work.

IT'S YOUR MONEY -- you aren't doing anything wrong, so don't give them an opportunity to stop you.

FWIW, I have written "For Deposit Only" hundreds of times and never had it rejected. If I do write that, I NEVER sign the check too (i.e. endorse it). In addition, when I write "For Deposit Only" I use all three endorsement lines and write something like:

For Deposit Only
Your bank name
Your account number

I do this out of paranoia because simply writing "for Deposit Only" (and especially if you sign it) could be stolen and deposited elsewhere.

i appreciate all of the suggestions to just try to deposit it into my account. i just wanted to clarify...for those who have done this...although the check was made out to BOTH your and your spouse.....the account was ONLY in YOUR name and you were able to depoist it?

In my experience, the account would have to be in both names. You would be able to withdraw the funds immediately, though, because having a joint account makes you agents for each other.

It seems to vary by state. One of the 3 states I've lived in wouldn't allow you to deposit, even into a joint account, without both signatures.
