Hello Everybody,

I have been off and on this site for five-and-a-half years. I could not save my marriage, but I want to save my custody arrangement with my two DD's.

I have my DD's two days a week (Thursday night to Saturday night). My ex-WW wants me to have them one day a week (Friday night to Saturday night).

She claims that too often I am late driving the DD's to school. Of the 36 times I drove them to school on Friday last school year, they were tardy nine times or one-quarter of the time; in each case, the kids were two to five minutes tardy to class.

Also, she claims I am tardy with my child-custody checks. My checks arrive after the first and fifteenth of the month.

I have two questions: Is my previous tardiness in driving my DD's to school enough cause for a judge to reduce my time with my DD's?

And would my case be weakened significantly if I had $515 in arrears with my CS payments?

Advice is welcome.

Why are you getting them to school late?

Do you have a Plan to catch up on your arrears?

Do you have a lawyer?

What was your previous posting name?
Regarding child support, that is supposed to be separate from custody.
Also tardiness can be a serious issue.
Has your wife filed anything in court?

Thanks for your response.

I have no good excuse for the kids' tardiness. My explanation is I live 15 miles away.

My plan to catch up on my arrears is to pay the $500 in arrears by mid-month and the regular $1,000 by the end of September. By then I plan to have a new job.

I have a lawyer and meet with her next Tuesday, the 8th.

My ex-WW has not filed anything in court. She threatens to file if I don't give her what she wants.

You say tardiness can be a serious issue. The ex-WW has not raised this issue since she moved out nearly SIX years ago. Why is she raising it now?

Plus, she was late taking the kids to school three times. Why should I be the fall guy? I think I deserve another chance.

Sir if your kids are late 25% of the time its an issue. Dont argue with me about it. The local judge will ask you why you are incapable of not showing up on time. Your kids have to explain to their teachers why they are always late.

I say tardiness can be an issue because some counties will punish the kids and others will file juvenile court charges against the parent.

If she hasn't filed anything dont agree to any change in custody without speaking with an attorney first.

There is a vast difference between 3 times late and 9 times late.. I would really work harder at getting them and you up and ready earlier if you're having a hard time getting them to school on time. 15 miles really isn't far.

Why can't you have the children from Friday night until Sunday night?

I strongly advice you to not minimize you bringing the children to school late. Whether it is 2 min or 2 hours is irrelevant...they are late. Chronic tardiness to school IS a big deal and will not go over well.

If you switch your days, get a proper modification in court.
