I'm losing custody of my daughter for fleeing the state. Can this be happening? I left with my D when H showed up with OW. Now, come to know i left the state while divorce was filed, so i flee the jurisdiction, and now H will get custody of 1 year old. what to do? any ideas. please help!

Nezi...this doesn't sound right. I think you need to find another attorney. I seriously doubt any judge would take a one year old away from their mother in these circumstances. Call your present attorney and verify that you heard him/her correctly. It just doesn't sound right...

First thing you need to do is find a new attorney. I'm not sure your current one.....from your recent posts....is doing everything he/she can be doing for you.

Did you leaving knowing that divorce was being filed? Did you leave after you were served papers?

I would like to know a few more details about your story.

What you mean by you left when your H showed up with the OW?

If you now know that divorce was filed.....find out the date it was actually filed.

What state do you live in?

i was at my parents, for about a month then H calls and asks for divorce. A month later i come back to where H lives and got an apt, to finish my last sem of school. a couple of days later, he asks to take daughter for a few hours. H comes in a diff car, i asked whose car, after 4 diff lies, he gets angry, so i let him go, at this point i'm very suspicious. later he shows up with OW to return daughter. i left the next day, and had no contact with him for a few months. but he did know where i was, i just didn't want to talk to him, at that point, now they find that irresponsible of me, etc. i don't understand how emotionally devastated you have to be to do something like that! i left and didn't speak to him. unsure of what to do now.

he had threatened to file but i assumed he didn't cause i had not received anything. I was never served, but he saying that i left to avoid being served.

i wasn't even there when it was filed.
