Since he was not living in the home with her, I would have to agree that he broke in.
I'm no lawyer, I would think that there is nothing wrong with putting it on a shared computer in the home, or if you have two computers in the home but both are shared by the family, then there is nothing wrong. Just my uneducated opinion.
