Here is a question for all you fellow canadains who live in ontario. A freind of mine is going through a divorce and me and the GF have told her to get temporary custody of her kids. Now her husband has been hanging the threat of taking off with the kids and her lawyer said that he can do that plus there is no temporary custody order in canada. I think this is bull but what do you think? Any good web sites that explain this in plain english?

From what I remember from last year during my separation with my H, you're right, there is no such thing as "temporary custody" of children. Here's what I can remember:

Whoever "has" the kids (residing with them) is considered to be the PRIMARY CAREGIVER. That person has the most rights. If your friend is still in the same household as her H, then things are different. There's nothing (to the best of my knowledge) that she can do. <img border="0" title="" alt="[Frown]" src="images/icons/frown.gif" />

Is she still living in the same house as her H?

It's really hard to find websites with current information on Canadian Family Law. I had a heck of a time, and I don't think I actually got anywhere. I just did a small search on yahoo, and thought you might want to try these sites for more info:
