I've posted before. I have a couple of questions that I'm not sure if anyone can help me with.

A bit of history: My husband had a brief affair that ended in pregnancy. The OW REALLY wants him involved (wants him to divorce me & marry her)... that's not happening. The OC was born about a month ago. H told OW that a paternity test must be done before she will receive CS and that the will be no contact.

So far, so good. We waited about a month before she called and gave him a number to call to schedule an appt. for a paternity test. Turns out the number is really to her dr's office so they can send him the bills.

We called and found a place that all the lrg hospitals recommend. He's planning to go that route - if OW will go there... otherwise she'll get nothing til she does. It's a nationally certified clinic as opposed to her Dr who has never done a paternity test.

Anyway... I know that it varies from state to state... but how does CS work? Can she sue him for CS without the paternity test (which he is pushing for)?

Another question.. H & I have 2 kids. If she collects CS thru the state, does that mean my kids take a legal back burner? Things are going well, but if he & I should get a divorce down the line, are my kids coming in last?

I'd appreciate any info or advice you can give.

Get this figured out now. If she collects child support (or welfare) through the state, the DA will come back to your H for back child support (if he is proven to be the father). You do not want his wages attached for back child support. So have your H take care of it now.

I would think that if she is sure he is the father she would agree to get tested. She may not be certain. But at any rate your H needs to know so that he will not be hit with thousands of dollars in a couple of years.

Ona,

Not sure what state you're in, but in CA I'm finding out that part of the formula (and they use a computerized formula in CA) in determining how much support will be ordered also depends on income, other children you have to support, ability to pay, etc. When I was hunting for a divorce attorney when my dear H filed, they were able to give me an idea of what I would expect to receive based on his income, etc.
