Do you guys know of the best arguments for getting Joint Physcial Custody of our children, which she took when she left after I found out about the affair, I live in New Mexico a "NoFault" sate. We are not even legally seperated. She has a restraining order against me, advice from her attorney, to keep the children for 1 year. I am going into court with witnesses to break that restraining order because she broke it only 2 weeks after it was placed and has broken it every 2 days or so for 3 months. How do I gget my children back 50% of the time from a cheating wife who took them? Thanks Guys

Well GA is a no-fault state as well.
File for legal seperation right away. This will allow you to force the issue of child custody without ending the marriage....legal seperation is sort of a dry run for divorce but its the only way you can force custody issues.
How did she manage to get a restraining order and child custody for one year? Seems fishy to me. A judge would only grant that stiff of an order if she presented so pretty strong evidence of you posing a threat to her and the kids.

Hey Stunned, the restraining order was because I kicked her under the table 2 years back. I was so in shock when I first went to court I would have admitted to killing 3 guys in Arizona if it would make my wife look better at me and the kick was true. She asked for a couple of months restraining order but in New Mexico the minimum is 1 year. But the wife can break it at any time.
