Well the mediation was over and I have some good news and some bad news.

Good News first.... I still have my shirt on

Bad News... well you can get the idea.

One thing that wasn't settled was what possessions I would be allowed to bring out of the house.

I asked for the furniture that is on the porch; a picnic table, a couch, and a bookcase.

I asked for two lamps one stand up and one table.

I asked for the dresser that my clothes are in along with the TV and VCR in bedroom.

Asked for a set of sheets and towels.

STBX replied as follows...
No to the stand up lamp. Yes to the old couch. No to dresser.
No sheets. Can take old towels.

No to the picnic table, instead I can take the dining room table. ( she didn't want me to take the picnic table because that is where she smokes. I guess the dining room table was more to her liking since that is where the kids eat and do homework. That is if she ever cooks.)

Didn't get any agreement, guess I asked for too much. A dresser to put my clothes in and wooden bench to eat on, and some lamps so I can see.
She has ceiling lights and multiple lamps in everyroom but she can't spare one. Go figure.

What you ask for is totally reasonable. I can't see why you have to agree to everything she wants all the time. What kind of mediation is that?

Can't a judge eventually make her give you half of all the furnishings. Like if you have two night stands in your bedroom you should get one. Same for lamps. Same for flatware, dishes, pots pans. All of that would be reasonable. Where does it say that she gets just about every possession the both of you ever owned? I could see if her parents gave you both something special for your wedding..say silverware...but if yours did then that item would be yours.

If she hasn't used your dresser why would she miss it?...She is being worse than awful...more like inhuman.

Will there be nothing fair when all is said and done with your D?

Makes me want to go over your house and give her a good talking to...but that's my old desire to fix all injustices...Probably wouldn't do any good anyway.

Trix is right, Tom. I am going through the mediation period too, and we live in the same state. FL is a 50/50 state. If this has to go before the judge, the judge will just say to divid eit evenly. She is better off giving you the few things your asking for. What the he!! kind of lawyer do you have? What's wrong with him? he should know this and be aggressive with her and her attorney about it. Or are you not using attorneys? If not, then now you know, and you can tell her this. Sounds like your mediator is terrible. Uggh.

I dunno what the laws are in your state, but most states divide property 50/50, including the house.

My guess is she wants this over with nice and easy and quick. That is your leverage. You can drag this thing out for a looooong time until she either acquiesces or you contest it via your lawyer, which is even longer and will force her (and you) to itemize EVERYTHING you have and split it equally.

Don't let this, if you'll pardon my french, scumbag, leave you with only the shirt on your back.

Once the property settlement is complete, you can never go back.

Looks like I'll be living off rice and beans for awhile (I'll cut out the beans if you change your mind about the teasing) But I like pasta too. I guess I should be concentrating on the "reverse" Adkins diet anyway so I can gain back some of the weight I've lost.

Trix, I'm not giving in to everything. It's just that she wants everything. I won't take anything away from the kids, unfortuantely she is leeching off them now like she was leeching off me. She knows, and has told me, that the kids get to keep everything, and <smirking now> she gets to keep the kids.

Like I mentioned in a previous post, she asked me what could "we" have done to avoid this mediation? My answer was to give her everthing and for me to sleep in my truck and eat at the soup kitchen. Well eating at the soup kitchen might not be so bad, since my STBX doesn't cook.
