found out OM hits WW...has done it for 6 months....called lawyer about D...OM does not do it around D....took D to councerlor monday ...we told D about it.....beat her up last saturday night............

lawyer told me that until meagan sees it or she gets hit there is nothing i can do.......meagan is aware of it.............

Frank...your lawyer is an [censored]. How do you know meagan hasn't seen the abuse?? I'd bet a year's pay that meagan has seen/heard plenty by now to be damaging to her...she's at a crucial point in her life and is right now taking in all she sees going on around her and will likely apply it to her future relationships! Get a new lawyer or call the law yourself, but do something! Don't wait until you get a call some day that your D has been hurt by this loser!

I agree with Dreamcatcher and echo her advice to find another lawyer who is more agressive and specializes in these kinds of cases [most initial consultations are free]. Maybe your D has seen the OM hit her mom but could have been threaten by the OM that if she tells you that she is going to be hit as well. Don't sit on your a** and do something about it NOW!

Frank..do you realize that if you wait until a 'disaster' strikes at your WW's place while meagan is there, and the law is called in, there is a good chance that Social Services will be called into the picture and a good chance that meagan will be put in foster care pending an 'investigation'?? Maybe different where you live, but here in PA I've seen it happen. Even if you had no fault in the matter, it's a good possiblity that Meagan won't be sent directly to you after the incident that is likely to happen sooner or later. Get her home with you now Frank.

Frank needs to stay within the law or he will end up in jail, and then Meagan will have NOBODY. His WW has custody of Meagan during the week, taking her against the mothers wishes will be considered kidnapping which will BLOW Franks chances of custody.
Frank get the proof from the Vet that OM killed Meagans cat, get all your docs in order and go down to the courthouse and request an emergency hearing from the judge because you suspect your daughter is in danger. You do not need a lawyer to request an emergency hearing when a child is in danger.

Frank, You have been here for months and have received a lot of good MB advice. I have a few questions for you:
Do you believe that after almost a year of living with the OM, your WW is considering rebuilding your marriage?
Are you committed to trying to get Meagan out of the OM's home permanently to live with you even if your WW stays with the OM?
Do you put your role as a father as the most important personal relationship you are in?
I ask these questions because the pattern here seems to be that you come here and tell us about some horrible drame ie: sexual discussions in front of Meagan, physical abuse of your WW, killing of Meagan's cat, screaming matches with you in front of the OM's house and yet I have not seen any evidence of your taking concrete steps to get your D out of that situation.
You tell us about the incident, we all get up in arms, offer good advice and then you do not update us or let us know your course of action until another "drama" unfolds.
Your lawyer has done nothing. Your counselor has done nothing, you wrote a PlanB letter and you NEVER told us what you did with it! <img border="0" title="" alt="[Mad]" src="images/icons/mad.gif" />
Here's the thing Frank, you are not obligated to do anything that you read here. You are not obligated to keep us updated, we have never personally met you. Not to be a wet blanket, but CS in many areas will not get involved until something actually happens. Here in Canada even an actual provable death threat won't motivate them.
Believe it or not, one of the best places to start is the school. If they see some changes in your child, they seem to know what buttons to push (and how to push them) to get the ball rolling.
I can't help thinking that this has probably really got you scratching your head in absolute bewilderment.

As you said Dewt, they may not get involved, we just don't really know for sure.
I would advise Frank to talk to child services, the police, free legal services, a minister, the school... ANYONE who will listen. At some point, he may stumble upon the avenue to saftey for Meagan.

Hi, FYI, as one who grew up in a household where abuse was commonplace,
I was "around" when the abuse happened. In another room, usually. I would pretend to be sleeping. I knew that what I heard was not to be spoken of. Knew not to talk about it in school when teachers or guidance counselors asked if "anything is wrong at home?" Denied, denied, denied. Protected the sick situation in our home my whole life.
My parents thought I was protected from it. They didn't know I heard it all. I never trusted anyone enough to tell what I heard.
Your D knows; there is no way she has not heard, seen, or felt the menace. Get not only x-rays on the cat. Get a necropsy done if the carcass is still around. Abuse on an animal is designed to instil fear in the humans. "You're next if you don't shape up." Punching walls sends message "This is what I can do to you if you don't shape up."
I perfected a wide-eyed innocent stare when questioned. Had it down to a science how to play dumb. It's really sick. Child protecting parent. But I did it as long as I can remember, even before starting school I have memories.....
Get a more aggressive lawyer, and talk to the school folks. Keep working as hard as you can to protect your D. Your wife won't do it. I know you can!
