my wife went to her parents for thanksgiving and i went deer hunting. she was 4 hrs away i was 2hrs away i decided to come home a day early. i pulled into my house to find a u-haul and almost all my stuff loaded up. if i would have came home when i was supposed to everything would have been gone. i guess my situation is done, as in no chance for reconcilation....
in her haste to get all of OUR property she forgot to load her clothes. she called and wanted to come back and get them i told her i would leave them in the driveway, didnt mean it was just pi$$ed off. the next day she called and asked where the horse trailer was she wanted to come get HER horse and i said no. i hid the horse trailer. i did tell her very nicely that i would give her her clothes and that she could come by and i would bring them all out. so she shows up with the police and she started loading alot of other stuff and there was nothing i could do.... so what is my next move, i guess my 1 week of plan a wasnt very effective.

that is where im at, i have been asking around and have figured out the nastiestest lawer around. but we have a small problem, the weather here is bad and the lawyers phone is down..... which sucks. i call th # every 30 seconds.

can you go to his office? do you have kids? How can she just take so much stuff? Sorry I am not familiar with your story. Why did you not call the police when she was taking everything with out you two agreeing? You should have.

Don't panic. There is no need for that. The situation is urgent, but it is not such an emergency that every second counts. Domestic legal battles don't play out that quickly - it's just the drama makes it seem that way at first.

Make sure you find a lawyer you feel comfortable with. This person is going to know personal things about you, and you want him or her to understand where you're coming from.

Typically the property stays put if it is in "peacable possession" and there is dispute over ownership. You likely could have said: "I don't want that to go". and it stays. She is entitled to her personal possessions ie. clothes and toiletries.

the police were there and told me that this is common, they could not get involved because it is civil not criminal. they also said this would make her look bad in court. after she was done they asked her if she had gotten everything, she said yes and they told her to not come back , which pi$$ed her off and she said she has as much right to be here as i did and the officer said no you dont, you have made your decision clear and have nothing left here dont come back...

So you say it stays, she says it leaves...she tries to take it, you say no and hold it. She pushes/hits/shoves you to get it, they get involved. Peaceable possession - you…..it stays.

The ownership of the residence and the contents come under civil law and she actually can come back any time to get in and get more stuff until the courts say otherwise. It's a grey part of the law here and the police are loathe to get involved. They told her what they needed to, to keep you guys apart and prevent further disputes that can escalate into something volatile. Hopefully she will believe their "bluff". The time spent here is time better spent speaking to a lawyer and closing accounts.

dalson,

EveryTHING in that house is/was marital property.

You need to start taking inventory of what is now gone. Make the list while it is still fresh in your mind.

Make a list of the things that she removed,and what is now left. You are going to need it later when it comes time to list marital property and assets.

Maybe you've figured this already... but you really let her stomp on your toes there.

I'd like to know what stopped you from refusing to let her clean out your house!

while she was so busy loading up anything of any value she forgot to load her clothes and a few other things ie our bed, tv from basement, 1 recliner, 6 towells , stereo from living room. i came home a day before i was supposed to and probably stopped them from completely cleaning house, so to speak. when i got there they all hauled a$$. she called back and said she needed her clothes and i told her they would be in the driveway. well i calmed down and told her she could come get them and i would bring them out to her. she showed up an hour later with 2 cops, 1 of which we go to church with. he said not to get upset and give her any ammo to use. he said the judge in our county frowns on adultry and doing things for spite. and she was being completly uncooperatable, and him and the other deputy would testify to how completely levelheaded i was versus how vengeful and angry she was. so her calling the cops actually helped me not her

Riiiiight.

Wow, people in affairs seem to turn evil overnight, don't they? It never ceases to amaze me, even after hearing so many stories and seeing it for myself.

This is not real P.C., but sometimes I think adulterers are just plain mentally ill.

i dont know if you have read my previous threads but, the real amazing thing is im the devil because i yelled at her and emotionaly abused her because she stayed out al night or i would get upset because she lied. and i was invading her privacy when i got the proof of the a. and also when i exposed it to the d@#k heads wife. and im the devil

I was wondering if you have considered since one of the Police Officers was your wife's friend, that he was lying to you about the judge being anti-adultery simply to get you to not contest her taking ALL. Less resistent.

Some so-called "friends" when in a position of power (police) can abuse the priviledge and use it to their friend's benefit.

I say change the locks NOW! And do whatever you can to prevent her from entering your domain which she so willingly left.

no hes actually just an aquaintance from church. after she got everything he told her to get off the property and dont come back. it was pretty funny. then he hung out in my shop with me and a friend of mine who is a friend of his and gave me advise and volunteered to testify on her state of mind

Okay Dalson, that's good to hear.

You still need to secure your house. Change those locks. Re-key your garage door opener and take one of the wheels off the horse trailor, or park it at a friends.
