Hi there,
I was put on full bedrest as of tuesday. I find out today from a mom that called me at home that my boss had filled my position at work and did not even talk to me about it. The mom asked if it was only for when I was on leave and she said, no, its permanent. The mom asked, can you do that? My boss said, I can do whatever I damn well please. Well my question to anyone with any law background is she able to do that? <img src="/ubbt/images/graemlins/confused.gif" alt="" />

H and I found out about OC 5/11/04
Recovery has been wonderful
OC Born 1/7/05 (Husband's 1st Boy)
Reluctantly have C but isn't constant due to xOW's games
H has a D from previous marriage 1/98 (don't see her due to crazy ex-wife)
Our first little one born 6/2/05 at 3:23 am 9lbs 2 oz -Cayden Michael-
Wouldn't change my life for anything!!!

Are you in a "right to work state"? If so yes......If not....well they have to have reason and medical is not one of them.

Hurt, I am sorry I have no legal experience or advice but I had to chime in and say "That sucks!" If your boss is that cold and heartless then maybe it is a blessing in disguise that your position has been filled. Try not to worry about it now -- just take care of yourself and your little one. That is one thing about the childcare and/or teaching professions -- there are always children who need to be watched/taught and usually a job available somewhere doing that. Just take care of yourself -- I was on bedrest for the last 5 weeks of my first pregnancy and I know it can be hard. Hopefully, your doctor will opt to go ahead an have him soon. Hang in there, Mommy!

Hurt,
It all depends on your length/terms of employment. Have you been employed more than 12 months and worked more than 1250 hours in the last 12 months? Does your employer employ more than 50 people? If so, you are covered by the federal Family and Medical Leave Act which requires that your employer provide you up to 12 weeks of paid leave and return you to the same or similar position upon your return.

Thanks everyone. I'm just shocked that she would do that without confronting me or telling me something. I was planning on looking for something else but she had no right to do that really. I have worked there for 16 months and 1250 hours. She only employs 8 of us so that doesn't work. I already looked into it. Its just wierd to have a job one day and then not the next without any explanation. I guess I just will have to deal with it. What bothers me the most is she knows what problems I've having with my pregnancy and I'm suppose to reduce my stress levels.....do you think that reduces it? Lol....*sigh*
