Ok - let's say you own and another person own a business...Other person owns alittle more share of the business.
This partner is married - though that's not pertinent to the situtation...This partner had 2 PA's with employees (now former)of the company. He most recently had yet another PA that is now it's EA with a married employee.
YOu have voiced your concerns to him regarding sexual harrasement by having A's w/employees - but he continues.
Where would you go next? Yes, this just so happens to be my WH - I am now looking at in from a business point of view not just a marital issue. We could lose our business or be sued over his A's..and I don't know what to do anymore..
The only side I see right now is to file for a D - get my 1/2 of the business and RUN...I cannot buy him out that's not possible...
Could our corporate attorney talk to him? Could a letter be sent telling him what he could be stepping into?
How can I get this MOW out of my business??? He tells me I can't fire her - what can I do..

Talk with your attorney...and consider inviting a divorce attorney into the mix as well.

I agree 100%!! If ever there was a time to see a corporate AND divorce attorney(s), it is NOW!
WH is showing NO regard for you, your feelings nor your financial well-being.
JMHO, it's time to extricate yourself from this mess as CLEANLY as possible. It may hurt (emotionally and financially) in the near term, but the long term liability of staying seems too risky from my point of view.
Protect yourself should be Job #1 for you right now.
Be well, be strong and keep posting...I'll be looking for yours.

Thanks for the replies - I think I knew the answer - I just wanted opinions - since it is my WH I didn't want to "look at his behaviour" from a BS point..I wanted to see if from a business partnership viewpoint..
I would think if his partner was another man - the man would go to him first and let him know his behaviour at work as intolerable and it had to stop..And hey, I've done that...didn't work..His male friends who are in the same type business spoke to him - that didn't work either..
He repeadidly tells me - NO ONE IS GOING TO TELL ME WHAT TO DO.......I DO WHAT I WANT....
I have been to a couple of divorce attorneys - I'm just still sitting on the fence..waiting to file,,I swear I have learnt to live/deal w/this dysfunctional relationship. I have learnt to let so much roll off my back - becoz it is what I am use to - does that sound crazy????
My divorce attorney will request all partnership/business documents from our corp. attorney - This will send a HUGE RED FLAG up.. All documentation will be reviewed b-4 I file any D papers. Anything they withhold will not be admissable in court - which is a good thing in case I signed something years ago that would disolve my ownership in case of divorce. Just covering my butt here..
Since I have NO hard evidence pictures, etc. of my WH w/these employees it will be alittle difficult to prove he's had inappropriate relations.
I really wish I had a way to fire this latest one..Everyone tells me - just to walk in and fire her - How do you do that??? Should I talk to the corp. attorney - tell him rumors are running thru our business, her BS has called me as well as my WH and it would just be best for her to seek employement elsewhere - or could this cause one hell of a lawsuit?? I may be better off - getting out and running for hills and letting him continue on his path of distruction. He's gonna mess w/the wrong one someday..and I don't wanna be around for that..

I would seek the advice of your corporate attorney...QUICKLY! Having your DA request the documentation from your CA was a good start to " shake up" your WH. I would hope that he MAY "see the light", but that may not be the case.
That's quite a sticky wicket...if you fire her AND there is no "admissable in court" evidence, a lawsuit from OW would be forthcoming I am sure. Doe the BS of MOW have any evidence?
Secondly, having the MOW is the workplace is INTOLERABLE! That your WH will NOT "nicely" dispose of her (ask her to quit/fire her)speaks volumes of his value of your feelings IMHO. Can the BH of the MOW put pressure on her to leave SOON?
There seem to be a lot of moving parts in all this and it all seems to hinge on whether or not your WH will REALLY re-commit to the M and start that process by relieving your business of the MOW.
If he doesn't do that, your near-term difficulties are sure to increase, but it seems that your WH is a train wreck waiting to happen.
I would hope that your extrication, at least financially, will not place an untenable burden on you. The emotional pain is a given, but, as I have learned the last two months, the emotional pain WILL lessen and become more manageable.
Hang tough...I sincerely hope your WH gets his $h!t together!!

What 'proof' do you have? If needs be, hire a PI to get the proof. Or take steps yourself to get the proof you need. Are there any witnesses that could testify as to what they've seen? I've not followed your thread...how do/did you KNOW that there was an A or A's going on?
Not bashing you here...just trying to think about what you would need to make this stick in court. And firing her WITHOUT some kind of damaging evidence could get you in a lot of hot water as well. So figure out what you need to GET the evidence, and at the same time work on a game plan for what your next steps will be when you've got it. I'd talk with the divorce lawyer and the corporate one anyway, just to get clearer information on how to handle things...what are the risks of the corporate lawyer taking this back to your H?

Hi ItHurts,
If you could get out of the business with out loosing my shirt, I would do it. I'd even sacrifice some money if I had to, to remove myself from such an obvious potential time bomb. You've gone through enough pain without having to live the rest of your life waiting for the next shoe to drop. SOMETHING bad will happen (via wreckless WH) that will affect your business. That's just too much stress to live with.
The corp lawyer cant MAKE him behave, and WH KNOWS he's risking the business, so I see nothing the lawyer can actually do. Best of luck to you! - Dru
