Well, it's been nearly six months coming...but our hearing is tomorrow morning! Just the thought of things being bonafide is such a relief!
My H has all his ducks in a row, but OW has not filed the paperwork (tax info etc.) that she was supposed to, does anyone know what kind of ramifications this has in court?
We can't even be sure that she remembers the hearing is set for tomorrow, what happens if she doesn't show up?
Everything else is fine. OC has been with us for the last week for our summer visit, we will have her until June 6th, and then my H and I leave for our very first vacation alone together - 10 whole days in Virginia Beach!
Wish us luck tomorrow! We're almost there!

[color:"purple"] IF she has been properly served & doesn't show, then usually you will get what you want by default.
If she does show & does not have her requested paperwork in order, she can request a continuance for 'more time' & another hearing date will be set. It is up to the judge though.
Good luck, be sure to let us know how everythign plays out. Reemmber...tell H to dress nice, professional, but in womethign he will be comfortable in, if he's comfortable he will feel more comfortable about everything.
I forgot do you haev an attorney? IF not, remind H that he needs to be assertive if he's representing himself.

Just wanted to update.
Hearing went fine. OW showed up with her mother and the judge stuck to the parenting time and visitation agreement they filed together.
However, the judge did reduce my H's child support obligation. It is now half what it was.
WHEW!
That's it. Done. Finalized. Legal and binding.
Here's to the start of a beautiful summer, and the end of a horrible, chaotic experience trying to get a legal visitation order!

Hi Vic, Just curious. OW filed a vistation agreement? What was it. I don't think our OW has even addressed the subject yet. What were the circumstances that the judge reduced H's CS obligation. Just curious.

My H actually called OW after not being allowed to see OC for over eight months and offered to terminate his parental rights if OW wasn't going to allow him to be part of OC's life. OW balked.
Her lawyer told her that she'd better work something out for the sake of her daughter (go lawyer!). So, OW and my H filled out the parenting plan and visitation schedule together and filed it with the court together.
We get OC every Weds overnight, and every other weekend from Fri night through Mon morning. OW and H will alternate major holidays and we get OC for two full weeks during the summer.
About the Child Support, my H is a sub contractor and only made $6,000 last year (I make all the money). Because he was making $10 an hour working full time when OW first requested a Child Support order (in 2001) he was paying an amount based on that income. When he initially asked for a modification of the original order (this past December) he was denied, even though his income would've allowed for a smaller amount. We were told by the Child Support Enforcement unit that anyone can find a job making seven dollars an hour at McDonalds and it wouldn't warrant a reduction in his obligation. When he and OW filed the parenting plan the court HAD to revisit the CS issue by law, and based on his tax returns for the last two years they lowered his support obligation by $100 a month.
It was a quick and painless hearing, and when the judge asked OW if she was all right with the CS reduction, she didn't bat an eye. I'm glad, too. With all the crap she pulled with the arrears last year it was a pleasant surprise.
