I have a son with my ex-lover. My husband knows and has always known and at the time he was born I had moved back with him for reasons I really don't care to go into. This caused a lot of confusion as to how to document the birth and out of frustration I agreed to put H as the father. My son is a year old now I'm regretting it. H was reciently reported to CPS for child abuse by our neighbor. I chenged my schedule at work so that I am home when the kids are home thinking H was going to be removed from the home and also he isn't alone with the kids for very long. Well he wasn't and now I am preparing myself for asking him for a divorce. I am almost positive that when I do he will deny the baby to avoid paying CS. I want to avoid this and change the info on baby's BC to name his bio-father. Can I do this? The father does not deny him but has stayed away to not cause any problems for me since he understand why I moved back home to begin with (no it wasn't to save the marriage). Can I have the info changed without much of a problem? What are my options?

I think it's more his problem to prove he's not the father than yours. When and if he does, you can then go through legal system to contact ex-lover and get CS from him.

Also, I do NOT think you can change the BC info w/o permission. Not sure if you need H permission to change it but also you would need proof of paternity to ADD OM name on it.

I THINK the way to go about this is to file legal papers for CS & establish paternity. Which might just happen anyway if you are divorcing & H is going to contest paternity. But there should not be any contest IF you are not going to sue him for CS for the OC. kwim?
