I just found a check from the mortgage company for an escrow overage (I am really pretty well organized - I don't know why I just found it). My name and WH's name are on the check, so we both must sign it for it to be cashed. It becomes void over the weekend, so I must cash it today.

Should I take the check by his work and ask him to sign it - or should I try to find someone else to take it to him? We don't have an official intermediary. Everything financial has gone through my lawyer or by quick pass through the door, so far. I could possibly ask my mom, but I don't want to make her feel 'used.'

What do you think I should do? And yes, I do feel stupid for not finding the check until late last night during a paperwork clean up. <img src="/ubbt/images/graemlins/crazy.gif" alt="" />

Could you take it by his office and ask someone else there to take it to him for him to sign?

If not, you could ask your mom - take her out to lunch to say thanks, then she won't feel used!

Does he have a secretary or something? Could you go into the building and ask her to have him sign it?

I doubt that your mom would feel used, she'd probably feel useful!

Do you have any accounts that still have your H's name on them? If you do...you can deposit the check into that account and just withdraw it immediately. The endorsement on the back can state "For Deposit Ony". The bank teller usually has an endorsement stamp that will state that.

Unless the check specifically states that "both parties must SIGN" I would do that.

That just might work. He does not work in an office, but someone he works with could take it to him. If I didn't sign it until after I got it back, then he'd have no reason not to return it to me. Thank you for your suggestion, Alph. <img src="/ubbt/images/graemlins/smile.gif" alt="" />

Committed, the check does not specifically say we both must sign. I just assumed we would, with both of our names on it. We do have a joint bank account, unless he has taken his name off of it without me knowing. If I can deposit the check this way, I can make sure to leave his half of the money in the account.

I'm no expert... still in Plan A, but I'll give you my opinion anyway.

You'd get the best effect by having your lawyer send someone from the office to get the check signed. If that option is not financially feasible get someone official and stern that BamBam doesn't know that introduces themselves as a "representative of Ms. Pebbles".

I didn't realize that it doesn't say you both must sign. I can deposit checks into our joint account even if they ONLY have my H's name on it (even when we weren't married and had different last names) because both names were on the account. The teller explained to me that as long as the name on the cheque and the name on the account was the same, it's okay.

Hi, losttranslation. Hmmm, I can't think of anyone off hand.

He's probably pretty peeved at me about court Wednesday. I don't want to push it. <img src="/ubbt/images/graemlins/smile.gif" alt="" /> Getting money he wasn't expecting should improve his mood, don't you think?

Hmmm, I just tried to log on to check on the joint account online. It says the account has been locked. I tried my individual account and it worked fine. It looks like WH has been busy.

That locked account is the one the mortgage is directly withdrawn from.

Hmm, maybe he just changed the password. I can probably fix that, LOL. <img src="/ubbt/images/graemlins/wink.gif" alt="" />

I'm going back to bed for a couple hours. I can worry about this when it's light outside.
