Well LM, I'm trying to figure out the next step. I cannot get the car back WITHOUT WH picking it up. I called him yesterday and today, and left a message. I can't believe that he is willing to just leave it there. The car is a 2002 Ford Windstar, and is paid off.

My attorney is no help. He says nothing can be done until WH is served, and the car is in my name.

In California the law is the law says that marriage partners need to exercise fiduciary duties of care, and owe each other the highest duty of good faith and fair dealing.

That is what the law says, but I have very little faith in the court system.

I took off work today, and am thinking of sending WH a telegram letting him know that if he doesn't pick up the car within 3 days, I am going to go out and buy a new one.

What do you think?

NOw that is what I am talking about? F your WH. Get the divorce from this scumbag done. You may need to be extraordinarily creative in getting this done, but I have no doubt that if you set your mind to it, you can indeed do it.

Get a new car, and then do all that you can to OFFICIALLY divorce the piece of dung.

Thanks LM - I KNOW that I can do this. Since WH has been gone, my life is much better. I have been promoted 3 times at work.

I for one appreciate your straight forward manner. Lots of us here tried the MB plan. But for some of us, it is time to move on with the kick [censored] divorce plan.

Sorry Believer for what happens. Since you are not officially divorced, if you buy a new car, your H will be responsible for half of the debt, right? But I would write an email to your WH so that can be served as a piece of evidence - that you HAVE BEEN asking him to either get the paper or pick up the car for you. And since WH has been IGNORING your request, you have nothing but one option - to get a new car. Ask your lawyer if there are any other legal actions you can take!

Hey believer, if you can v. well afford a new car then you should! Treat it as a new beginning of some sort... !

I'm also starting alot of things anew...I'm even venturing into studying insurance and intend to start being an ins. agent --- something which I've never done before!

I'm thinking about it. But I love my van. Go ahead and try something new. Since D-day, I have had 3 promotions, and am now working in contracting. I never would have put in the effort and time studying if WH had been around.

That is one of the great things about all of this cr*ap. We are forced to grow.
