Does anyone know if you can find out what was read from the text msgs from your spouse's phone if it was deleted? I found the 800+ msgs on my cell phone bill from the past 6 months. He wont tell me anything. Says he cant remember what the conversations were about. Can I ask a lawyer to have those records pulled if I file for seperation or divorce?

Cell phones store messages in a memory chip. Once they are deleted, there may be a way to uundelete the data, but it wouldn't be an easy task. If the cell phone account is in your name, the company can and will provide you with detailed records of all activity on the device. If it's in your H's name, they will not release the information to you or your attorney without a court order. But lawyers sometimes know ways around this.

The cell phone is in my dad's name. I can ask him to get them for me. I already know the ph#s and to whom they belong to. I just wonder what kind of detail they will give? Will I be able to read them? And if I do go to the lawyer, will they let me read them? I would just like to see what they talked about or if they had meetings. I do have the gut feeling, believer, that an affair had been going on, but would like to know for sure. He is not opening up at all. I gave the notes on 'dishonesty' and 'what is an affair' for him to read. Nothing though. He is not talking to me about it-at all. I am shutting down big time because of this.

I would think that they won't have the actual text messages themselves. If your husband has had that much contact with a woman in so short a time and can't remember what was discussed, you pretty much have your answer. Unless he's planning something really bid and secret, like the world's coolest surprise party, he's at least having an EA. His lack of communication is an even stronger communication. Tell him if he has nothing to hide, you need to see those messages before he erases them. You can always put a PI on him.

Maybe you can call the cell phone company and ask for a detailed bill that shows the phone number the text msg was sent to/received from? Not what you want, but maybe a help..
