I was reading through a couple other people's posts, and all of them said not to leave the home, to make the WS...or FWS in my case leave.

So should I not be leaving?? Should I tell my husband that I'm not leaving and that I'm not signing the dissolution papers??????

I have another post regarding my trip to see the lawyer today....he says that the landlord cannot have me removed, as my husband had said earlier......

So should I be leaving and Plan Bing him.....I seriously doubt he's going to leave....and there is no more OW.

Just wondering.

Caren.

Here in canada, I had asked my lawyer when my H and I seperated if I should be the one leaving, after all I couldn't make it on my own in this town, I would rather be surrounded by family.

She asked me if I wanted to keep the house. Since the house would have to be sold - and H and I agreed this, then there was no reason for me to stay in the house from a legal standpoint...but if I wanted to keep the house - to not leave under any circumstances - that he would have to leave.

BUT - I wasn't looking at it from a PLan A, Plan B standpoint. So I cant advise you on that. I think the main thing about not leaving, is that you want to make the concequences to your spouse's actions uncomfortable, and them having to leave the house is much more uncomfortable than you leaving the house to them.

I hope someone can advise you based of Plan A/Plan B.

Hi Caren. I wouldn't leave. You and the kids need a place to live. If you don't want the divorce or dissolution then do not sign it. I know it is tough because you don't want to live there with him and you can't plan b with him there.... my h for the longest time refused to leave. He would tell me I could go whenever I wanted but he wasn't budging. Freakin cake eater. grrr.... finally I said ok. Found a place for the kids and I to move to and it is half an hour away.... he said ok and about 2 days later he says, ok, you can have the house.... I wonder if that tactic would work for you? hugs, mlhb

Caren,

Don't leave. I stood my ground and insisted that I got the house and I am glad I did. Think about Caren - why should YOU leave? You are the BS, the victim and he wants you to leave?

Well we don't "Own" the house, I moved into a house he rented after our separation.

And, BTW......he won't leave....no way.

So should I tell him that I'm not going to sign the dissolution?????? Should I tell him I'm staying put????

Mortar thinks I need to go to Plan B.......but that would require one of us leaving.

caren, I don't know if I am the best person to answer your questions. You know my situation and it as well is pretty messed up! but I want to think on this a while and get back to you on what you have asked. in the mean time maybe some of the experts have some input. You always have great input for me... and right now I am speachless on how to help you.... but I am thinking about you! mlhb

I think Star has some experience with an inhome separation, wonder if something like that would work in this instance?
