My H and I received a letter from the Human Resources Dept., it gave us the date of the hearing for child support (April). We still haven't done Paternity yet. We have retained an attorney. I don't know whether her H has done the test or not. I don't know what they have done.

I was expecting a Petition to Establish Paternity, but what we got requested that my H come with all his financial papers, etc. Is that right? All info would be helpful.

Generally, CH, they would include the petition for paternity with all the other paperwork unless it has been done already.

Maybe they did the test on the H and found out he was not the F so just saying that your H is, I am sure your lawyer will put in some request stating that you want a DNA before it goes any father. I would tell your lawyer you are not going to hand over nothing until the DNA test.

Our first set of papers was a paper to establish parentity, but there was also more then one possiable F listed on it. It then just stated that we had so many days to answer which we did by saying we did not agree and wanted a test done. Still found it weird that they are not mentioning anything about establishment. From all the reserch I have done, alot of state now say that if couple is not married then they have to establish parentatiy before action can be done, by test or by admission

these sound like very selfish ,hateful and uncaring people. i would think most people in there place would just let it go raise oc as their own, so they dont have to deal with mm and his w.

im thinking two things, either they are just awful people,in which case i feel sorry for oc, or the bh wants his but covered in the case they split up he doesnt want to pay cs. i dont understand why they would do this. if me and my h were in their shoes i woulnt want to bother with op we would raise as our own and never have to share.

then again its not always in our hands, its in gods. have you prayed and asked for his guidance. mayybe he has other plans for this oc. i know its hard and that you wanted nc. but just maybe he has other plans.

what did your lawyer say, i think they are just hoping your h will admit without pt. but i know you will not. do ow really think we are all that stupid. have lawyer send back petition to establish paternity. i dont think any judge is going to make h pay without pt.

trust god, things will go the way there meant to go. im writing a new post letting all know our recent talk w ow, oc is here i dont want to do on your thread. but your one of my support group and i want you to know, were somewhat in same boat. unfortunitly we cant afford lawyer. anyway good luck, keep us posted. remember were all here for you.

imtswife...thank you for the kind words...the lawyer and my H have spoken...the hearing will be for the Paternity test according to my H. He is calling the lawyer back now to clarify everything.

I'll read your post...and your right...it's all in God's hands...and no, we are not stupid, but she thinks we are.

OK good they will do paternity test first on her H before they can ask your husband to do so... make sure your lawyer puts that in his response to order to appear.

YOU do NOT have to give them any financial papers untill the paternity is established. Do not volunteer anything at all and make sure you keep all your personal info blackened out they have no right to your info at all.

crazy hurt the first lawyer my H had was a moron and my husband did not interview many lawyers actually none at all. He just went one and figured he knew what he was doing since he was an attorney and all. LOL I knew more than the lawyer because I called many attorneys and got a free consult over the phone. He fired that one and then we went and interviewed about 5 and decided on of course the first 1 we saw that month lol. She is a baracuda I love her to death. She is great. I hope your husband did see more than one attorney cheaper is NOT always better trust me we learned that lesson.

We only spoke to this one....we belong to one of those legal networks, and this is the attorney's office they gave us...so far so good. We had a billion questions, but he said before he spends our time, which is our money, on alot of questions, let's get the main question answered first, and that is whether the child belongs to my H or not.

I would like my H to make sure that the attorney knows that the OW's H should take the paternity first. I'm not sure if he did or didn't, but I want to make sure that its done.

I will discuss that one thing for sure.
