My wife is going to file seperation papers on Monday. We have been living in seperate homes for the past 3 months. The reason seperation papers are now being brought now is because she has found out about a North Carolina law called Criminal Conversation. She thinks that the BS of the OM is going to take her to the cleaners using that law. We have a house that is under construction but after all is said and done she keeps saying that she does not want any of it because it is being built on my family's land. She tells me that she is getting the paperwork to protect me from the OMBS trying to take her part. What does anyone take of this?

Is the affair still ongoing? How does gettting a legal seperation protect you this? Why not call the OMW and ask what is really going on here?

I am from North Carolina also and the BS....and have been dealing with a WH for some time now....I have done ALOT of reading up in otherwords!

from what i have read about the above there isn't a thing she can do right now....legal seperation won't help her at this point....the deed has already been done and the BS in your sitch can still "take her to the cleaners"

If the BS knows of the A, has evidence (phone records, etc.) legal seperation doesn't matter now. Also BS can use alienation of affection as well. read up on NC divorce law.

I may be wrong ...but from what i have read...seperation now makes no difference.

OW in my sitch...is loaded. Hmmm.

Seperated: 8/24/05 WH was living next door at his mom's hanging out at our house all the time until... AUGUST 28th, 2007....I moved out...2008 we started reconciling...still seperated but moving forward...getting ready to move back together...until boom JUNE 2010....a new affair begins...NOW...

I have filed for Divorce.
