D not filed - though, WH received a letter from my A - stating a agreed upon separation date..His A never responded/agreed..So basically, we are no where yet..

So, WH trades in his car - the title has his name and mine as the owners. I didn't sign any paperwork. If you trade in a car for another one do both owners need to sign the papers???? or can he trade w/o my signature????

He could have had one of his bimbo's forge my signature....Boy, I hope he didn't do that...or heads will roll.......................

If you are on the title, I don't see how he could legally sell it without you signing the title, or if you gave him power of attorney.

Of course, check with your attorney.

My XWW wanted to trade the minivan for a New Beetle during the divorce. I wouldn't sign off on this until there was a signed agreement about the disposition of the remaining cars and the debt she obtained for the new vehicle.

I wanted my two 10 year old cars in exchange for giving her the van and it's equity, as well as not being liable for the debt she obtained to buy the new vehicle.

She balked, but I said I would not sign off on trading the van, owned by both of us, until there was a signed agreement regarding our vehicles.

I would ask your attorney how to handle this, and how to ensure you are not on the hook for any debts he obtained to trade, as well as getting your share of any equity he traded for the new vehicle.

I know as a Notary Public, in my state ALL owners of the vehicle need to appear before me and sign...and if I personally don't know them, I request their driver's license and make a copy of it for reasons as you stated.

It's possible when he traded it in, the dealer didn't realize it was a co-owned car, or WH did have someone pretend to be you. The title will need to be filed with your state DMV probably. How long has it been since you suspect this happened? You can ask your attorney, or do you know where he traded it in? Is there a way you can ask someone at that dealership? (i.e., "I think my grandmother's ring is behind the seat" might work...)

Avondale - The owners card for the traded in car has both our names on it. When he traded before, the dealer (since we knew him) just had WH bring home the papers and I signed them. I did tell WH many months ago that I would not sign off again. Though, I would have I was just mad at him. I do remember when I got my new car in WH's name and in our business's name that they made a copy of both of our drivers licenses since we never pruchased from this dealer in the past.

The new car is from a dealer we have never dealt with. He traded his older car in for it about a week ago and paid cash for the difference (24K)he used funds from his personal account (though it's still marital property).

I need to find the paperwork which is probably in the car, that will show if they required me to sign and if one of his bimbo's pretended to be me and just oops, forgot her driver's license. He better hope he didn't that...my attorney will not be happy...and nothing would give me more pleasure than to file charges against this homewrecking tramp.....forgery is not a game to be played when D is looming....

I really think his attorney is advising him to dump cash and to take more $$$ from our business...They aren't stupid they are masterminds at the game...

sometimes on the vehicle it will be listed Mr. AND Mrs. Insertyournamehere. Sometimes they will list it as Mr. OR Mrs. Inseryournamehere. That is what happened to us. We purchased 2 vehicles the same day, the van for me was OR the truck for him was AND. My van has long been traded off and the next was only in his name. Which me screwed up on. The truck he is still driving because I refused to sign it to him, so that he could sell it, when he is done with it it is going to our daughters. That is what it says in the divorce also. So you might want to look, it is AND or OR.
