I served WH D papers a few months ago. WH is having an A. He thinks that since I served him D papers, we are in a LS, so he is justifying living with OW now. (He was living with her before I served him anyway) WH Fog or is serving D papers a LS?

Dumb WS. A Legal Separation requires paperwork, you don't wonder if you have one, you know. A divorce also requires paperwork along with it going before a judge.
Not a choice of being in one or the other. Stupid WS.

you do not have a LS just by filing for D
my H and I have a contract....in my state, it's not even considered a LS because although it has been noterized and IS a LEGALLY BINDING CONTRACT even it is not a LS because it has not been entered into the courts and signed by a judge
my H is probably telling everyone we're divorced anyway
they live in fog land where "lies become truth".....i think it's a faraway place like OZ

Some states don't require anything other than an affidavit certifying that you having been living separately for the required period prior to filing for divorce.

LS or not, you are still legally married until the D papers are final.
WS will grab onto anything to justify what they are doing.
If YOU won the lottery, do you think he'd turn down half the money by saying, "hey, she filed for divorce, therefore we are legally separated so gosh I'm not entitled to the money!" No way.

Me, BW WH cheated in corporate workplace for many years. He moved out and filed in summer 2008.

WH would be right there if $$ were involved.
It does not state anywhere on the D documents that this is a legal separation until the D is final.
In our state we have both a LS and a D. You can file for one or the other. Some people file the LS first, then go on to the D. I just did the D first. I actually didn't even think about a LS at the time. Maybe I should have filed that first, as I am still torn regarding the D.
Anyway, I agree. He is just pulling crap out of his butt to justify him living with OW. We aren't living together anymore, I served him, so in his eyes even though the D papers haven't been signed, our M is over and he can do what he wants.
