My WW was awared 2000.00 in PSS yesterday on top of 1500 CS.

My question is now can I go back and have CS recalculated to include PSS as part of her income, seeing the IRS does.

What happened in court? Do you have an update?

I would think that $3,500 a month in PSS and CS would be unfair unless you are making a killing in your employment, considering that you have bills to pay as well.

I do make a killing 200K a year and she works at target as a pharmacy tech so there is a great difference, but I took on all marital debts so its tight right now.

So I am trying to cut things out and I am also going back and trying to get the CS lowered.

I feel a little better knowing your income while also knowing there are bills to pay. Good luck on the PSS/CS issue.

I am more concerened about the custody matter as the money sounds like it will take care of itself when the actual hearing comes and the truth comes out as to her [censored] actions.

I strongly believe that you CAN. PSS is income to her that should be included in the CS calculation. (unless the Judge's order for some reason specifically states that the PSS calculation takes the CS into account (doubtful) OR the CS calculation specifically excludes PSS by statute in your state). Your attorney should know this hands-down.

Probably won't be the biggest adjustment as your incomes are still quite disparate.

Wish you could be a fly on the wall to see her reaction when you file to properly adjust the CS....as she likely thinks she's quite on easy street after her seeming "victory" yesterday.

So tonight is her night with dinner with the kids, I took them to my comlex's pool. I tried to get the kids out of the pool to get them ready to go with her. Knowing that they didn't want to go.

THey begged to call her and ask her to come over to my place to eat. I was resistant at first but thought she wouldn't come over after yesterday.

Wow she said yes she came over and hung at the pool for over an hour, while the kids were in the pool. We actually had a conversation it was small talk but it was pleasant.

From my lawyer she is insistant on filing for D, but I am holding my breath and hoping that she will delay and will start thinking more about it, but I also think she of a mental state that she does no wrong and will be better off D.
