No not an attorney..just lots of research and lots of attorneys have weighed in on this.....OW was married to another man that she had abandonned but not legally seperated from....she defacto perjured herself when she declared a marriage to my H....her lies don't make the documents legal.....she is the only person who has standing to challenge the BC as her H is assumed the legal father...until she or her H proves otherwise.
My H has no legal standing to open a paternity case because of OW 's marriage....and frankly he isn't subjecting himself to that CATCH 22 because he doesn't want to establish that he could be the bio dad. It is this OW's burden to prove who is responsible as a father. Obviously she's unwilling to prove this ...........but unfortunately OW keeps making false statements about legal matters that affect my interests.......I can only circle the wagons and protect my interests legally...which I have done.
My question was about others in the same boat who had dealings with a psycho MOW.... who lied about relevant material facts to illegally have a false name placed on an OC 's Birth records. If there is no signed declaration by the supposed bio father...the law says no name goes on the BC...the only exception is that the mother may place her H name without his consent at the time of birth if H is not present. and the Hospital confirmed there was no father at the birth.....and she made false statements in admission paperwork including a fake SS # for my H....the biggest lie being that she was single, WTF...but then told the nurses that she was married during the "course of the pregnancy"...but was then divorced ????????
