Ok we are getting harass by our manager from our HOA. They have a house next door to us that is for sale and he said that one of the Real Estate Agents complained about out yard. At that time we had the lawn treated right before this happened and the company that took care of the lawn left signs out in the yard so if the saw the yard to complain about it then they also saw the signs. The company that took care of the yard told us not to pull the Fiscue that was growing in our yard because the Fiscue was what was keeping our Bermuda sod in place because it hadn't taken root yet so we didn't pull it.

Then after we recieved two notices he sent the one day apart threating to fine us if the problem wasn't resolved. So we had a landscaping company come out and he said that the lawn company sprayed the yard for weeds and it was working because we didn't have weeds what was growing in the yard was Fiscue. He then said that the landscaping company that the bulider used didn't do a good job of perparing the yard before laying the sod and he then said the same thing as the lawn company that the Fiscue was keeping the sod in place and he recommended that we not pull it because by the time the weather heated up it would die anyway and by that time the Bermuda will have taken root.

So the manager called the house with a really bad attitude and told me that if we didn't fix the yard he would fine us and I told him what the lawn company and the landscaper told us and I said if our yard was not up to his standards that he could tell the real estate agent that complain to come and fix it the way they see fit and I would have no problem with that. He then said that he could send someone out there and if he did it would cost us $100.00 I wanted to tell him I was willing to pay $200.00 if it would make him shut the ****** up. I didn't but it took a lot for me not to. I talk to my neighbor about him and she said they all had a problem with his attitude. The worst part about it is that he is on our back and by the pool and pavillion area they have dead shrubs and weeds that are so big they look like weeds and he is constantly on us. The perservation areas need to be tended as well and while he is harassing us he could use that time to find someone to fix that problem. How can he hold us to a standard that he isn't even adhering to himself. We pay the HOA over $700.00 a year and I can gaurantee it is not to harass us.

If anyone has any advice on the sitch I am all ears. I can't take holding my tounge to long. I think Biff the Stiff is a real jerk. I know he is trying to do his job but there is a way to do things and he is choosing to do it the wrong way. Not to mention we never get any notices while the empty house's yard is in bad shape but as soon as the yard gets cut we get another notice. We are out there every weekend.

I don't know what else to do and they have some yards that look way worse than ours. If he is going to hold us to a standard shouldn't everyone be held to the same one? We are mad and desperate. I am thinking of contacting the builder and telling him what is going on.

Take a copy of your Homeowners Association agreement to an attorney. Have it reviewed for what can and can't be done by the Association, etc.

With 2 lawncare companies having reviewed the lawn and given their professional recommendations, take that to the attorney as well. Discuss with him the possibility of a letter to "Biff" to stop the harrassment or you'll see him in court.

Time to put some "muscle" into the picture as "Biff" seems to like "flexing the biceps."

If you don't want to go the attorney route, find out when the next HOA board meeting is and take your case to them to see if they can "rein in" big Biff.

Good luck.

Forever Hers that sounds like a very good idea. I think it would be more than worth my time to do that. It's seems like no matter what we do it's not good enough. If for a piece of mind if nothing else. Thank you for taking time help me with this sitch.
