please,if you prayer, keep me and my children in your prayers. my ex has informed me today that he intends to take me back to child custody court. i am assuming he is going to try AGAIN for full custody. (it kills him this much to have to pay child support and the fact that he lost in court last year)..

i don't need this, my kids don't need this. and he needs to move on with his life. this will mean another petition of lies i have to read, i have retain my attorney again, and go through all of this nonsense again.

Sorry to hear this. But realize that the WS is being jerk....again? Hm........ Ok, in addition to support go do your work. Get the last paperwork, update it with more WS' activity and be prepared.

R U using a legal assistance? If so, get 'em up to speed. Don't just assume you are going to win this case. Prepare for a strong fight, even if you win hands down.

I know it's not about winning but it is a war.

yes, again. he tried to get custody last year as well. he left in july of 05 and the summer of 06 is when he did this the first time. my kids had to get a law guardian, and probation had to investigate us both. when all was said and done, probation wanted him to have a mental health eval. to make it fair, the judge ordered us both to have one. probation was only going to offer him 2 weekends a month and that was it. i offered him 2 weeknights during the week as well to be fair. that is what he agreed to. his lawyer advised him to take it as he was going to lose the case. he gets fair vaca time and holiday time.

bottom line is, he HATES paying child support. he wants that money for himself because he is selfish selfish selfish.

i still keep records, altho i had gotten a little lax because we had this settled and signed by us and a judge last year.

there is no need for this except that he doesn't like to lose, wants all his money for himself, and wants to control a situation he no longer has control over. add in that his ow is just as nuts as he is and you have a winning combination.

Therein lies your key.... he is being selfish. Know that there isn't enough $$ to satisfy the A so he is now willing to hang his own kids out to dry. Make sure that point gets across in a form of a question in the next hearing.

Also let the judge know you are afraid he is head towards the deadbeat dad course. Well at least let your lawyer know.

last time he tried for custody i was able to use the affairs against him seeing that he was living with the latest ow.

he had an arrest pending against him for kicking in my door, and shoving me against a wall in front of the children along with yelling a string of obscenities at me. the police came and made him leave and i had him arrested. he has since pled guilty to harrassment in the 2nd degree and still has a RO against him until november of this year. (was a complete stay away, now it is just that he cannot harass me and the kids or threaten us in any way).

he did pretty much make the case for me last time, he probably will again. i just don't want to go through it again.

I know how difficult and troubling it is when your ex creates a custody case out of lies and BS for their own selfish purposes. Keep you head up, and stay strong. Don't let the kids be damaged any more by your WS' self-centeredness.

I hear ya too! My ExH is threatening to take me back to court becasue of DD living with him now. I can't afford to go back to court, but my lawyer told me that I can't ask for fees from him. Not sure why, but she said I couldn't.

When dealing with an ex like this you have to understand he will appreciate only one thing, force, coming at him from that perspective is all he will get.

I would counter claim to increase child support, reduce custody time with him, increase alimony if available, if he is living with OW ask that the children not be exposed to her, ask for all courts costs and attorney fees,...

In other words when an idiot like this tries something like this you have to make him pay or he will never get it. Get a mean azzed attorney and file a counter claim to stick it to him like he is trying to stick it to you.
