I just need some advice or information. I know that continuing to think about the OM justs gives him more power and I really don’t want to think about him or what has happened very much. I just want some opinions on some of the things that he did, just because I keep wondering. I know I’m not making much sense. Here is what happened in a nutshell. OM2 is a part owner of a local gym. I joined it and talked my wife into joining also. After a few months there, my wife and I were going seperately and she was using him as a personal trainer. One day he took her in his office to supposedly show her something on his computer. It was supposed to be some pictures of himself when he used to compete or something. I’m not quite sure. Instead of showing her that, he showed her pictures on his computer of his genitals and some of himself engaged in sex with some other married gym member. This is how the A started with my wife. Now I’m not going to do anything now, because I want to finally let him go, but I can’t help but wonder if there was any type of action that I could have maybe taken legally against him and/or his business. I’m sure if my wife hadn’t consented to his juvenile behaviour there might have been some type of action we could have taken. I just want to know if anyone has any opinions they could share. I know that I will be told to just not worry about it and let it go, but I am just curious. It just bothers me that this jerk is using his business to do this type of things with his customers. Any comments?

You say he's a part-owner of the gym. Have you exposed his activities to the other owners?

Oh Rock, what a peach this guy is.
I don't think it's illegal because they are consenting adults. If he did it to one of his employees or a minor, then I think you've got a legal issue.
But you could expose him to the local media, chamber of commerce, etc. if it will make you feel better.

I did inform the other owner and he told me that he was going to take care of things. Come to find out they were pretty good friends and nothing was ever done. I wrote him after I had found out because I wanted him to know that I knew what had happened and he sent me a threatening letter telling me that he was going to get a restraining order on me and that he could sue me for slander. I let it go, but I have always wondered what I could have/ should have done and what maybe some of you might have done. And yes, he is a real pos. Why my wife went along with this scumbags advances are beyond me, but that is another story. Thanks.

RockSolid, you can expose to anyone you want including his customers, his wife (if he has one), his friends, family members, etc. It is slander if it's a lie. I don't believe legal action can be sucessfully taken against you if you were telling the truth without exaggerating, no matter how disgusting the truth is. If he wants to sue you, he would have probably have to spend his own money and time hiring an attorney and he has the burden of proof to show that you did spread rumors about him, those rumors are false AND he actually suffered damages as a result of your false rumors. As matter of fact, if he sues you, you can probably counter sue him for intentional infliction of emotional distress.
Regarding legal action against him, you probably don't have any, because there is no fiduciary duty or contol from him to you or your W. She's a consenting adult with the sufficient mental capacity to enter into an affair.
It would be wise to consult with a local attorney who's well aware of the law of your jurisdiction before any action is taken.

Thanks for the opinions. I don't want any trouble. The thing that bugs me is that he threatens ME with legal action for messing with my wife. I just hate the fact that I was paying this jerk monthly fees as he was fooling around with my wife. I guess I hate the fact that he got away with this and could possibly be doing it to other customers. I also hate the fact that my wife didn't have the sense to report this to me or someone else when he did this. I guess every dog will have his day.

It was seduction and he has every legal right to do it. You cannot blame him more than you can blame your wife. He did not make any promise to you, but your wife did. You also have the right to tell the truth to anyone as long as you don't exaggerate or lie.
I can threaten you with legal action if you ever buy a burger from Burger King. Does that mean I will be able to win and collect money from you if you go do it?

Well, ok then. I just know that I work in retail and with the public and if I were to pull a stunt like that, I am sure that I would probably get in some serious trouble for it. I will not go out of my way to attack his business, but if anyone ever asks me about it, I will surely not recommend it for personal reasons. Thanks for the thoughts.
