I live in NC where we do have alientation of affection and criminal conversion(?) laws. However, I met with two different lawyers who had no interest in pursing this lawsuit because, 1-its hard to get money from a judgement from the person and 2-it would cost me a lot of money and 3- hard to prove.

Has anyone attempted to serve papers on the op in their case? I was just wondering what the other person's reaction was.

I've personally never did it because we don't have it in Texas, but I sure did threaten to call OW to the stand to testify or depose her as a FACT witness. If you can't find an attorney to go the AOA route, maybe ask about having OP subpoenaed as a fact witness. Just about ANYTHING can be asked in a deposition.

I am also in NC and I (as well as OW's BH) served A of A and CC lawsuits on our wayward spouses affair partners.

While it is true most attorneys won't take A of A cases because of the reasons you listed, my and OW's BH lawyers did take our cases because we have proof of the infidelity so our chances of getting judgments against both of them is very high.

In terms of their reactions, both my WH and his OW think the lawsuits are meaningless because they don't have any money to pay a judgment. However, they will still need to spend money to defend against the suits whether they have the ability to pay a judgement or not. Not to mention the fact that both of them (and several of their buddies who support their A) will have to go through depositions, etc. Not fun!

Just another way to bring pressure to the A...

If you can afford it and find an attorney who will take your case, I say go for it. NC is one of the few states left that has laws on the books that actually punish adultrey. Don't let that opportunity go to waste.
