This is a cold question, I know. Say a person is do to get about $300,000 of inheritance. Of course if she/he is married his/her mate gets some of that. However, does the x mate still get if they already separated but the x spouse Inherits it after the divorce?

Depends on your state law. In California, the inheritance is the property of the spouse that inherited it, whether they are married or separated. If that money is comingled with joint property money, then the story can change.

You can look it up online, but I would check with an attorney too.

Check w/ attorney...but I think that it is not considered joint property unless the bequest is made to both of you. However, my legal opinions are worth what you pay for them.

Whatever you do, do not put the money into an existing account that is shared by you and your X, or has any money in it at all. As well, I would insist that account be titled with the words 'Separate Proerty' included to make sure it is know that you do not consider this as common property.
I don't know if it applies the same to you. But I received aroudn $5000 in life insurance after my father died. It is sitting in a separate account, untouched, untill this between my spouse and I are settled.

In my jurisdiction, as long as you keep the inheritance separate and in your name only, it remains yours whether you are married or not. If you put it in a joint account, it becomes "ours" or if you put it into the house, even if the house is in your name, it is considered family property and no longer yours.

KoC: Why are you seeking advice on how to keep money from your wife and son, if you are a father "second to none"? MBers: I suggest you check out his other posts before deciding whether you want to help him do what he's trying to do. ETA: Here's one of his more recent threads, I think it's one of the few he's posted responses to: http://www.marriagebuilders.com/ubbt/ubbthreads.php?ubb=showflat&Number=2094727&fpart=1

I don't know that KoC's behavior means that he shouldn't get advice on how to keep money that is rightfully his. Nor do I think his behavior means that he won't be generous when it comes to his son.
