My WW is continuing an affair(she doesn't know I've tapped the phones) and I'm planning for all possibilities. My question is about the custody of my children. Since this man has been in prison twice for drugs, the second time for manufacturing meth, is it safe to assume that I could get custody? I think he may still be on probation or parole. He has turned his life around but I still don't want him, in any way, to interact with my children. If he could I know he would go back to drugs and I think if my WW pulls her head out and he's never able to see her again he probably will. Also, since I have taped conversations of them would these serve as evidence or would they even be admisable?

Wiretapping is illegal and could actually get YOU in trouble, that is, unless your phone is VOIP...which makes application of the wiretapping laws questionable (they may still prosecute you or make you appear bad for doing it).

As an attorney, I am directing you to seek an attorney in your state for direction. Do NOT indicate you have already "tapped" the phones. Place any and all "recordings" with a trusted friend or relative and get them out of your house and possession just in case you are asked one day about them. In fact, you should delete your post above in case it is ever discovered and never mention anywhere or to anyone that you did this. Your case sounds strong already...so don't mess it up with illegal activities. Snoop, but don't get caught doing anything illegal as her attorney will use it against you.

There is a thread here on GQII called "Snooping 101". There are other, errrr, more legal methods of obtaining covert information than tapping the phone lines. Be careful though, in some states it is illegal to tape nearly anything. But even an illegally acquired recording CAN protect you from your wife were she, for example, to perjure herself under oath. The biggest value of recordings is knowing the questions to ask later and knowing the truth about your life. Other than that...they don't exist.

Finally...go to the infidelity Gen'l Questions II (GQII) board and start your thread there. Though this board seems active today with all the Palin groupee's...GQII is the most active board here. There are old threads about obtaining custody to be found as well.

Best advice:

Consult an attorney
Don't move out
Be wary of her getting you tossed out via a trumped up restraining order (this is where a recorder helps you as well)
