I am currently monitoring my WW's email, but am wondering if it is illegal. She is an employee of a University, and her email account is a staff/faculty account. Is it legal for me to log in and read these emails?
Also, I have a keylogger on our home computer, any legal issues there?

I believe it can be considered as a theft for that company, so yes I believe it to be illegal.

the email is one of those internet access types, with no security other than a password. It seems identical to the email that they would give to the students, the login screen just says faculty/staff.
The reason i ask is i want to know the legal repercussions before i expose to the university.

Are there any warnings on the site? It's not like you're "hacking" into it since you have the username/password. A lot of browsers "remember" this information if you have it set that way.
What does exposing to the university have to do with it? You don't have to tell them where you got the information, unless you're going to provide printouts of the emails. I wouldn't do this.
I would just make them aware of the affair and that you believe there is communication going on through email, then they can do their own investigation into the email servers if they choose.

i wasn't planning on telling the university how i know, but my WW knows that I went into her email when i discovered the A 2.5 weeks ago. She has since changed her password, but with my keylogger, i still have access. I am just worried about what happens when they confront her at work about it, she will know that i went into the email and may tell them that.

Is this while she's trying to explain away her affair? She's going to say, "Oh, but my husband went into my email and read those inappropriate emails!" I don't think so. She may come home again and change her password thinking that you guessed. Just keep quiet about it all. If she confronts you, your mantra should be it doesn't matter how I know, but that I know. And more than likely the university will be more upset about a potential sexual harrasment claim. I don't know your whole story but they'll go into CYA mode. How you read the emails will be the LAST thing on their minds.

not planning on giving up my source, or telling anyone i can still get into the email. I am just a little worried about having charges pressed against me after all the [censored] hits the fan, either from the University, or my WW. I own the PC i installed the keylogger on, so i am probably clear there, right? Just a little worried about how serious the university would take a non-employee/non-student deceptively logging into one of their email accounts.

to get into the whole story, WW is a research resident, in the middle of a 3 year residency. OM is married and on staff at the university. He is not quite a professor, but close, he runs on of that labs that WW has to help out with a few times a week. You couldn't say that he is her boss, but she does take direction from him on certain things.

there can be legal issues with you going into that companies email, that email BELONGS to the university, not your wife. Its just the same as if you were to open a locker, the staff can do it but you can't, not legally anyway.

You were in your WW's email account. This is not the same as hacking into the university email system. The school will not after you.
Do not reveal how you know you just know the truth, and that's all that matters.

Plus...to go after you and/or prosecute you they need evidence.
The best evidence they can get is an admission.

She gave me all her passwords and consentually gave me permission to look at all her emails.
without evidence...no prosecutor will go after you for a "he said, she said" case involving adultery. They don't want to get involved.
As far as your wife pressing charges...same thing PLUS they waywards never prosecute because that involves having to testify in open court exposing themselves as an adulterer. They do sometimes threaten prosecution but rarely follow through...they are only hoping to manipulate you to shut up and take it.

so, it seems that most people agree that I am in fact breaking a few laws, but that I shouldn't worry much about getting prosecuted. That sum up everyone's opinion pretty well?
Even if prosecution is a possibility, it is a risk i'll have to take, so i guess it doesn't matter at this point.

I agree with this post. You are worried about nothing. Expose to the OM's department, University president, OM's wife and family and get this A into the light. Now. Your WW should quit her job now. Both OM and WW are likely violated university policies in their private use of university email to conduct their A.

Muse..it is NOT a civil issue..it is a criminal issue.
I would do it anyway...but at least let's be clear that he is breaking a law. While he has a right to put things on his computer...he does not have a right to access her company email. That is a crime.
