My WW has been arrested twice for punching both of her ex-H's. She has hit me numerous times but I never called the police because I didn't feel like I was in any real danger. I kinda thought it was funny at the time actually. She had to go to anger management classes for her behavior.
I'd like to file for full custody, but I don't think I have enough cause for a court to award me full custody. WW, aside from having an affair during our marriage and having an affair during her first marriage, takes decent care of the kids as a SAHM.
I am her third husband, and I think she's trying to line up husband number 4 with OM...
Under what conditions were you as a FATHER able to get full custody of your child/children?
Do you think I have a chance based on your experience and knowledge?
I am a 32 yr old betrayed husband. My wayward wife is 31. Married 3.5 years. Found out about affair when it started around 10/1/08. Affair started as emotional via internet, then went physical. Wife moved out on 12/27/08. I filed for legal separation to get visitation with my son--wife countered with big D but now says she is in no hurry to finalize the D?? Currently in Plan A. 3 yr-old son. 7 yr-old step son. 11 yr-old step daughter.

It will be an uphill battle to get full custody. Consult your L. From my situation, I had to be able to prove that the kids lives were in danger or my exWW was mentally unstable. Unfortunately in most cases courts don't give a toss about adultery

Wow! I guess this is a comprehensive answer to my question. I doubt whether I shall have time to read it.
Erichh I would appreciate the filtered version.

Definitely gather proof and document your WW's affair. Although it does not affect custody, marital misconduct will allow for a 60/40 split of assets in your favor (I know because I'm from Missouri).
If you want custody, you are going to have to document her getting physical with you, and/or the kids. Get a digital voice recorder, and next time she hits you, I would get her on tape admitting it (like you ask, "why are you hitting me," and she answers, "because you are an a-hole." I would then file a police report documenting the abuse. I would run this through with your lawyer first, but you have the advantage of thinking with your brain rather than your emotions. Give her the rope to hang herself with.

My EXWW attempted suicide after OM1 dumped her. I got a sole custody exparte(sp?)for 3 months. She had supervised visitation during that time. Then once I was satisfied that she was no longer a danger we went to court and I was awarded Primary Domicilary status, so if she ever messes up, I can pull the plug without going to court.
