One other thing to think about is that in some states you are required to be living apart "as man and wife" for a certain amount of time before you can file. Once you sleep together (sex or no), it starts the clock ticking again. My point is if she wanted to fight this, she could always say, we were never separated!

I am not very patient, but I have to be right now. I have talked to him about the amount of time, but seems there is not much we can do. Must just be the county I am in. He also told me that do not be surprised if they (I guess the courts) try to get me and ww to go to counseling before hand.

I have to tell you (again) ... I don't care for your attorney. I have worked in a litigious environment for 20+ years and any good attorney can get a complaint completed and filed IN ONE DAY.

For the most part, this is standard stuff with 90% of it being copy/paste verbage. In most cases, it is prepared by a paralegal or legal secretary and ONLY reviewed by the attorney. He has had this for several weeks now ... and it appears it will be a few more.

He IS working for YOU, yanno???

PS ... I have also worked with/against attorneys who NEVER met a deadline ... they were ALWAYS behind. FWIW, these are also the attorneys that the courts have NO RESPECT for and typically rule against them. Your attorney is displaying a level of IMCOMPETENCE, which, I'm afraid, will bite you in the a$$ before its over.

He hasn't done SQUAT yet ... GET A SECOOND OPINION.

I've also worked in the legal field for many years and another scenario might be that he HAS filed it but the clerk or the deputy may not have prepared it for service yet. Still, if your attorney says he filed it, you can call the clerk of that court and find out the status on service yourself.

I have gotten several opinions. The first one was a female that is known in this area as a bulldog. She did not impress me at all. did not seem to be on my side. The second was a guy who literally told me that I do not care how many affair you prove. You will have to pay this and everything will be split in half. This guy was recommended by several friends of mine that have used him. the moment I talked to him and told him my story he was like you do not have to prove anything to me. I know she is cheating, you know it, and this is what we can do. He was straight forward and to the point and listened to what all I had to say.

Yes but what's the status of YOUR lawsuit? Has it been drafted? Has it been signed? Has it been filed? Has it been served? What exactly is the hold-up?

But that's 3 more weeks ... UNACCEPTABLE.

Back to pm's questions ... is the complaint finished? ... have you signed the complaint? ... has the complaint been filed?

Basically, I would want to know if this was an attorney problem (i.e. the complaint hasn't even been drafted yet) ... or is this a service problem (i.e. the sheriff has a back log of documents to serve and can't get to this one before 1/26/09)???

If its a service problem, there's probably not much you can do other than not voting for the sheriff next election, but if your attorney is just procrastinating ... LEAN on him ... EXPLAIN the he11 your WW is putting you through with her continued contact with OM. (hint: you should be able to find out the status from your complaint from the receptionist/secretary)

THERE IS JUST SOMETHING ABOUT THIS DELAY THAT DOESN'T MAKE SENSE!!!
