My H cheated on me and had an OC. We tried to move forward but I learned today that OW is pregnant again and she believes my H is the father. My H originally told me he did not have SEX with OW again but he did. He had no choice but to admit his wrong doing again. I am done and want to move on because I am also pregnant. Both OW and I became pregnant at the same time. My H is a sick individual.

What steps do I need to take to get a divorce? Any advice? I'm in FL. Anyone ever do a postnup agreement?

It depends state to state, but I am sure you can read online quite a bit of information. LISTEN to your atty. That is what you are paying them for.

You are going to need to get your financials all in order- all the paperwork you can muster. Taxes, bank statements, debts, SS numbers, all that jazz.

I wish you well. How long have you known this latest tidbit?

Bethesda (I spent my childhood in a town by that name!), divorce laws vary from state to state.

You might start by reviewing what information you can get online. Here are some sites I've found useful (not for Florida):

http://library.findlaw.com/2000/Jun/1/127793.html

http://www.divorcesource.com/info/divorcelaws/florida.shtml

http://www.divorcelawinfo.com/states/fla/florida.htm

I'm sorry you have to go through this. It definitely sucks.

Make an appointment with an attorney, but, 1st thing Monday morning, go to the local family court and file for child support. If your husband tells you not to, don't listen to him.

Here's what could happen:

The OW files for child support and names your husband as the father.

Now, 30% of his income goes to supporting the OC. You get a divorce, you file for child support, and the children of the marriage get the short end of the stick and the OW is getting a lot more child support than you. In family court, he who files first, wins.

Can you file if the divorce is not final?
