Moving to Plan B in a couple of weeks. Before WW moves out I will have have a legal SA in place (specifies custody of kids and how financial assets will be split). The SA specifies that I will take ownership of the house and split equity with her. So my questions is should I move quickly on taking ownership of house (SA says i have six months to make it happen). Interest rates are good and i would like to have some upgrades done but I don't want to give her impression that she has no home to come back to.

For those of you not familiar with me or my stitch, sorry.... For personal legal reasons my stitch was deleted.

PS,

I would refinance as soon as you can get your act together, I don't think interest rates are going to move at least till after the election, I'm guessing your refinance will give you the cash you need to buy her side out, I would do that sooner than later because the market should start to move up one of these days. So having that locked in is to your favor.

I would not do the upgrades to the house until the divorce is final . Lots can happen between now and then, you could reconcile, you could lose in court in some way, like because the house is better a reappraisal is done and she could be awarded the additional equity

The real question I have for you is how is the value of the house being determined ????? You should get a current appraisal, if your not careful you might be giving her to much . Actually when you refinance you'll have to get a current appraisal anyway so there's the answer to that one.

and I suggest that along with the current appraisal, you should get a termite report and make sure anyone doing it knows of any dampness issues or possible dry rot areas to check out closely.

(That could effect the value of the house too)
