I agree. Get yourself out of there if Plan B isn't enforceable there. Your Plan B needs to be a very safe fortress.
Do see a lawyer and discover what your rights are as part of your Plan B preps. If he outearns you he is probably liaible for spousal maintainance.
Don't let him off with any of his responsibilities. Plan B is an opportunity for him to see just how un-fun an option a D really is.
You want your Plan B world well funded and happy. You also want his world to be as much of a struggle as possible without you.
