I believe that when my wife was infected with herpes, that her partner had to have known that he was putting her at risk by having unprotected sex. He did not tell her that he had herpes and, after she had been infected, she then infected me. I am now left with a life-long infection. At first I wanted to find and confront this individual. He is apparently also married and I wanted to make him hurt as he has hurt me. Reading the replies to my prior posts, this appears to be the wrong thing to do. I am left wondering if I could sue this guy for failing to tell my wife that he had herpes and the resulting pain and suffering that he has caused both of us. I realize that it takes two to tango, and we are working on getting our marriage back on track, but I really want to get back at this guy. For those of you who are familiar with the law, would a case like this have merit?

Contact an attorney and find if your State allows for legal retribution in cases like yours.
I would also consider telling his W in case she is not aware that her H betrayed her with another woman, and explain to her about the STD. You may save her life and her children's if he is still cheating on her with other women. Remember THEY are inocent and do not deserve any fallout from revenge on your part.

I did a little research and found out that cases like these usually do not end up accomplishing very much. It is difficult for the jury to take the word of a spouse thas has alreay proven themselves to be deceitful. Also, unless the party visited a doctor and was made aware that they had the STD prior to infected their partner, it is difficult to prove that the infection was done intentionally. You are right about notifying the spouse though, as there is a chance that she may not even be aware that she is living with an individual that is having high risk sex and already has an incurable STD. I am having some difficulty finding this individual though because they have an unlisted phone number and I am unsure about their address. I guess that I could see if a Private Investigator could find out for me, but this may be getting a bt carried away. After all, I am still married and do not have HIV. My wife does not love this guy and it was in part my fault that this happened. I guess that things could be much worse.
