My divorce is due to be final on September 25,nothing has gone according to "norms" in my divorce, but would still like to hear from others about how the decree is enforced. I live in Texas. I filed for divorce in November, H refused to get counseling for his drinking problem and also had a brief affair. He has fought me all the way begging me for another chance but refuses to do the one thing I need, stop drinking. Plan B worked for awhile but when i discovered the affair, i changed locks to home and he refused further financial help. He still wants us to reconcile but doesn't want to give up drinking completely. I need the legal piece of paper to keep him in line (financially) for the sake of my two sons. Does anyone know how the court enforces division of government retirements?<P>

In the miliary, it's "ask & ye' shall receive." It is paid out by the government. You don't have to worry about getting it. Most likely the same way with state/local govts.

Confused,<BR>As part of my divorce settlement, my x gets part of my 401k that is anchored until I am out of the companies employment for 5 yrs(don't ask why). Here in Oh they set up what they call a QCDRO, qualified court-ordered domestic relations order and it directs the company managing my retirement to set aside the portion she is entitled to and to direct it to her when she is eliglible.<P>I would think this is fairly common in all states. Check divorcenet.com for your state, as they have FAQ's they may answer this for you.<P>Good luck and God Bless<P>Bob
