Hello Carl -
Sorry to see your situation has not improved.
I think the answer to your question is that it probably depends on the state. You can find out more about that from either of these sites:
www.divorceinfo.com
www.divorcesupport.com
A visit to an attorney may be at hand - unfortunately...
Hope things look better rather than worse in the long run for you.
Janet

Carl - from this and your other recent post, it shows that you hvae tried more than most. At least you will know that if it does not work out you did your best to save the marriage and the "family" home for the children.
My situtaion is not much better. This morning I find myself clinging to false hopes, and getting e-mail from my H that he ordered a "How to get divorced" book...
I think you have a chance with the approach you are suggesting - a last chance for your wife to wake up and smell the coffee. Who knows - maybe she will.
Janet

Carl,
Before you "drop the bomb", I would speak to a lawyer. It sounds like things are pretty bad and may lead to a separation. As Janet says, each state is different, and any move by you could affect the divorce.
I can't hurt to speak to a lawyer. Most will give you a free consultation without fees.
I hope it does not come to that.
Good luck.
