I got notice from the Superior Court of NJ that I am scheduled for a "Default" hearing on June 28th.
Default of course, because my H decided to do nothing about my filing.
Anyone out there have any kind of experience or knowledge?
------------------
Pain is a given, misery is optional.

Hi BrambleRose-
I will also have to get a default hearing scheduled because like your husband, my husband also decided to ignore my filing. I really don't understand this because he's the one that wanted a divorce so bad in the first place.
I'm not very knowledgeable about this either, but the one thing I do know is by them not responding to the filing, it will make things a little more favorable on our behalf.
So hang in there. We're going to make it through this. What doesn't kill us will only make us stronger!
Hugs,
Roxy

Hi,
Default hearing?
So, if I did retain an attorney to answer my H petition, I am in a more favorable position, perhaps?
If I had not answered his petition, would I be in the same position as you are now..a default hearing...then the spouse has to get an attorney to appear at the default hearing?
Just curious about your comments regarding the person who filed being in a better position if their spouse did not retain an attorney to answer your filing.
I know this could be different in other states.
When my H filed for the 3rd time (after stopping two hearings), he has caused us both to incur legal expenses that are outrageous. MOney has to come from somewhere and I have had to take it from money I needed for my children.
If I had not answered, I would have been letting him walk all over me. I had to wake up and take a stand on what I believe is important and to reveal the truth about many issues.
If a spouse doesn't answer (like yours), you are saying that you are in a better to position to receive what you ask for since they didn't respond.
Just felt like expressing my two cents.
elo
