Hi everyone,
Well just when you thought you were moving along.... I haven't been here in awhile mainly because I've been moving on. Wife has been moved out for awhile now living with OM. Well tonight I got served my papers. Ow. That's it. The final dose of salt in the wound. I know everyone has been saying prepare yourself for this day and I thought I had. Ow. again. On the positive side. I got a job in Dallas and will be moving in a couple of weeks. Woohoo!
I just have a couple of questions for those who have been served. What the hell do I do with these papers? Do I go to the courthouse and sign them and that's it. Do I/we have to go before a judge? Just wondering what I'm supposed to do next. Any advice will help.
Brandon

I think you should get a lawyer to protect yourself and know your rights. I live in Texas and when I had my H served the papers my Attorney said if he does nothing with the papers we will have a divorce by default within 4 weeks. I am sorry you are here. There is still hope believe it or not. Just keep taking care of you.

I agree GG, see an attorney. Being "served with papers" can mean any one of a number of things. In our state, you would first be "served" with the complaint itself. This is probably what you just received. It is styled something like this: Jane Doe, plaintiff Vs John Doe, defendant in dissolution and divorce of marriage... It will list some facts about you situation, like when you were married, kids, home address, property owned.... The thing that happens next is the two of you can come to an agreement (like on custody and splitting assets and debt) or you can let the court decide who gets what. I recommend an agreement if at all possible. But, this is why you need representation. Take whatever papers you just got and make an appointment today! Best, M

As much as I hate to say it, I feel you would be smart to get an attorney also. and you don't necessarily want to use the first one you talk with. But you do need someone to help you take care of your own needs.
